No. This confusion comes from the voting on the house floor before the house passed it on to the senate. An amendment (# 8 I think) was proposed to allow cities with a population of more than 1,000,000 to opt out. Before the amendment was tabled a vote was taken to lower the 1,000,000 requirement in the amendment to 750,000 which passed changing the wording of the amendment (this was labeled amendment 9).
