CHL holder shoots man in Oak Cliff Dallas

#1

Post by newlife12176 »

Saw this story on the news the other day. Texas resident with Arizona CHL shoots and kills a perp who jumped in his tow truck and attempted to drive away. Tow truck owner left his truck running while he was walking around a parking lot looking for parking violations. News reporter and detective said nothing about the man claiming he was in fear for his life. Detective on TV actually quoted part of the law stating "theft during the nighttime". Regardless it was nighttime or daytime, the man was justified for stopping the perp from driving away in his truck. The truck owner was not arrested and released after questioning. Police investigating if Arizona CHL valid in Texas.

I've been told by many, including [Pre-paid legal service] who came to our CHL class that if you use deadly force, you have a high likelihood of being arrested even if it's a justified shoot. Left everyone with the fear that if we justifiably shoot someone, we will be arrested and forced to find legal counsel. I've seen and read several cases of this. I suppose it can go either way. Luckily this individual was not arrested. Anyone else seen this story? What would you do in this situation? Story below.

Most of the stories I've heard involving a good shoot by CHL the CHL was not arrested. There is a reason they don't allow TX Law Shield to speak in classes anymore...they are trying to sell something. Not saying it's a bad service, but they are there to push their product.

Keep in mind the purpose of the [Pre-paid legal service] rep is to sell you on their program. A common sales tactic for such a program and many insurance salesmen is to used scare tactics. Some will even take the most rare low probability scenario and use it as if it's common.

Insurance and other programs like this thrive on more subscribers and fewer claims. It seems simplistic to state this but it helps you to understand and see through some of the sales tactics.

Now if you are the one that gets arrested or sued, it may prove worthwhile.

All insurance is worthless until you need it. :tiphat:

I don't sell insurance. But got caught short on life insurance when my late wife died. Odds were in our favor (healthy mid 30s woman) that we didn't need lots. Then the diagnosis came. Wish'd I'd had 4x more than I did to raise the kids.

Since then, scare tactics work on me. :grumble

Heard on the radio this morning that the parents are stating there was no way their son would try to steal a tow truck (my first thought on comment was opposed to another vehicle). Of course they demand the driver be arrested. :confused5

"they" = DPS

IIRC, DPS laid down the law in my instructor class in 2013 that only DPS approved guest speakers could speak during the allotted class time, and then I inferred that DPS wasn't wanting any guest speakers any more. The instructor is to instruct, not bring in any other speakers.

Ahh.. but they're allowed to speak during "break" time and during times when there isn't any "instruction". Didn't change anything.

I mention to my students the availability of insurance and give them links to the options, but never invite a salesman to my class. I do not sell insurance.

The students are told it's a break and they are allowed to leave or to stay and listen. That is a change - it's not a required part of the class time with a guest speaker.

glad to hear this! Hope it is followed! The [Pre-paid legal service] folks took up 3+ hrs of our "class" time when I took my chl back when it was a 10 hr course. Between them, lunch and the shooting portion, the instructor might have talked for an hr max and most of that was answering questions.
