Straw purchase and private sales

Assuming we know what is required by law.....then it just comes down to whatever the buyer/seller agree to and what makes them comfortable. If you don't like the terms of the sale, don't buy it. Main thing is for seller's to advise the buyer of his/her requirements. I do let buyer's know that I need to view their TXDL or TXCHL. I also tell them if they would like, I would provide a bill of sale. Those are just my selling requirements and other's will differ which is fine.

This year I had a local buyer who insisted we transfer the gun via an FFL. So I met him at my FFL's house and we transferred the gun. It was OK with me as it didn't cost me anything extra so what the heck. I was, however, somewhat surprised. But we agreed to it upfront and that was OK.

At a gun show I was selling a cheap little gun that had belonged to my dad and the buyer didn't want to show his TXDL so I declined to sell it to him. He then offered MORE money than the asking price......warning bells going off at this point. Needless to say I didn't sell it to him. Sometimes you just get a gut feeling that something isn't right.

Me: Look at CHL, look at dude, yep, same guy. Look at money, yep looks real.

Him: looked at pistol, seemed to like it.

Swap money for pistol. OK, thanks, bye.

No need to over complicate things.

Ha ha ha..........I did forget the "look at money, yep looks real". With the rash of incidents of counterfeit money (especially hundred dollar bills), that is a real concern!!!!

To me, a straw purchase should be one where you buy a gun for a person that is not legally allowed to own one, such as a felon.

That is one instance of why some one might make a straw purchase, but it doesn't matter if the person can legally own the gun or not. I am not a lawyer, but I believe that there was a case where a person tried to use that as a defense. I believe he got convicted.

You can purchase a firearm and give it as gift to someone. But you cannot buy it for someone else and receive payment from them even if both parties can legally purchase the firearm.

It doesn't have to make sense, its gov't policy......
