arrest record?

Hi, I am currently filling out my yellow thingy to send it off and it ask detailed information about an arrest.

When I was 17 I was arrested for wreckless driving and held overnight in the jail, In the morning the judge came in and made me pay a fine for the wreckless driving ticket. but nothing else came of this, I left for the army shortly after.

I am puting it on my yellow sheet thingy but not real sure what to put for the outcome. I only stayed the night in the clink, no comunity service, no probation nothing else, just a night and the fine.

I dont have the answer for you.
But if you will post your present age it will help. Many things are ok after a certain length of time.

It shouldn't be a problem. Reckless driving is a misdemeanor.

Try to get a record from the place where you were arrested. I don't understand all the ins and outs of Texas courts. You may have to go to the city, justice of the peace, or county court.

I was 17 then and 26 now, so its been around 9 years

BTW, it is RECKLESS driving, not WRECKLESS. I drive WRECKLESS every day. ;-)

If you paid a fine you were convicted. To speed up the process go to the clerk of the court where it happened and get a certified copy of your record.

seems like she treated it just like a normal traffic ticket. either way, will call and see what I can drum up.

Reckless is a Class A Misdemeanor as far as CHL licensing is concerned. GO TO the clerk of the court who handled it and get a CERTIFIED copy.

Texas Transportation Code

§ 545.401. RECKLESS DRIVING; OFFENSE. (a) A person
commits an offense if the person drives a vehicle in wilful or
wanton disregard for the safety of persons or property.
(b) An offense under this section is a misdemeanor
punishable by:
(1) a fine not to exceed $200;
(2) confinement in county jail for not more than 30
days; or
(3) both the fine and the confinement.




Texas Government Code
Concealed Handgun Licensing
§ 411.172. ELIGIBILITY

(b) For the purposes of this section, an offense under the
laws of this state, another state, or the United States is:
(1) a felony if the offense, at the time of a person's
application for a license to carry a concealed handgun:
(A) is designated by a law of this state as a
felony;
(B) contains all the elements of an offense
designated by a law of this state as a felony; or
(C) is punishable by confinement for one year or
more in a penitentiary; and
(2) a Class A misdemeanor if the offense is not a
felony and confinement in a jail other than a state jail felony
facility is affixed as a possible punishment
.

Not sure what to do, Its almost a 10yr old offense, I havent thought twice about it since it happenned till I went to fill out the form.

My mom said the charges were dropped, but she is going to see the judge for me tommorrow, hopefully get the court papers for me. gotta at least put it on there, If it was dropped/throwed out or whatever she said do I need a piece of paper saying that or what? Will it even help, dont want to donate $140 to the state for nothing.

The judge isn't likely to have a clue about something that happened 10 years ago.

This offense will not stop you from getting a CHL, even if you pleaded guilty. The fastest way to get it resolved is to get a certified copy of the disposition of your case from the court. Each court has an office that is responsible for records searches like this. Send that document with your application.

same judge is still there, she is kinda a family friend.
City court, they have moved from one building to the other to another, so we'll see how that goes.

Tell all. A couple of friends in my class failed to do so and their license was delayed until all the proper disclosure and documentation was submitted. :roll: .

It is your license in question. Do whatever you wish, but you have received proper advice in this thread.

If you can't be bothered with getting the disposition now, go ahead and list the offense. DPS will then either send you a letter telling you to obtain a certified disposition, or they will delay your application until they can get a Trooper to the court to do it.

Either way, it will cause you delay. Some people are VERY anxious to get their license, some don't mind the wait.

It is up to you. Hope it goes smoothly for you. If you decide to not get the copy, I am very curious as to what DPS does in regards to getting the disposition. Will you let us know?

I plan on getting a copy if it exist, just gonna take some time. am trying to get my packet prepped as well as possible before I mail it off. If it doesnt exist I dont know what to do then.
