Additional CHL License
I assume it is not permitted for one individual to have two identical CHL licenses? The reason I ask: I carry every day with a pocket holster in my jeans, and I carry with a pistol wear pt-2 every time I exercise (5 days a week). When I exercise I put my CHL license in the pt-2 holster with my firearm (because I must have my license with me to legally carry). I often worry about forgetting to move my license from my wallet to my workout holster, and from my workout holster back to my wallet, and accidentally carrying illegally. It would be super convenient if I could keep one copy in my wallet and the other in my workout holster.
Next question, what is the penalty if a legal CHL holder is caught carrying without his physical license? So far I've never done this, but carrying every day with my CHL in my wallet and about 5 days a week without a wallet when I work out, it is bound to happen by mistake eventually.

Re: Additional CHL License
You cannot have 2 valid/unexpired copies of your license, same as drivers license.
When you move and get an updated CHL, for example, the old CHL (if unexpired), must be returned to DPS.
I suggest that you do what I do... Make a photocopy of your license and put the copy in a place where you are concerned you might have your gun but have forgotten your license. Also, scan your license and store a copy of the scan on your phone. That way, if you do forget your license you can at least show it to LE if asked. It might not be ideal, but it will show effort and may help mitigate any problems from not having the actual license. Couldn't hurt.
If you exercise with a fanny pack, that would be a good place to keep a copy.

TX GC 411.184
(d) On receipt of a modified license, the license holder shall return the previously issued license to the department.

When I moved 5 years ago and applied for an updated CHL with correct address, the instructions I received from DPS was to destroy the original.RoyGBiv wrote:You cannot have 2 valid/unexpired copies of your license, same as drivers license.

ETA: just looked at GC 411.181 Notice of Change of Address or Name - nothing about returning the original license.

Re: Additional CHL License
Interesting... My above quoted text from 411.184 was from CHL-16, page 13, "Modification". Looking at TX GC 411 directly, 411.184 is no longer part of the code online. I can only assume recent legislation removed it or incorporated it into something else....jmra wrote:When I moved 5 years ago and applied for an updated CHL with correct address, the instructions I received from DPS was to destroy the original.RoyGBiv wrote:You cannot have 2 valid/unexpired copies of your license, same as drivers license.

Regardless, the second license, if unexpired, cannot be kept.
jmra's first hand experience is that it's required to be destroyed. I'd go with that.

Re: Additional CHL License
That would be because 411.184 dealt with modifying a license, in other words, changing the category of license from NSA to SA.RoyGBiv wrote: Looking at TX GC 411 directly, 411.184 is no longer part of the code online. As of Sept 1, 2013, their is no more "category" of license. That change eliminated 411.184.
I do agree with you though. You can't have two valid licenses, so the old one should be destroyed.

Re: Additional CHL License
The modification mentioned there has to do with changing actions, Which isn't specified anymore.jmra wrote:When I moved 5 years ago and applied for an updated CHL with correct address, the instructions I received from DPS was to destroy the original.RoyGBiv wrote:You cannot have 2 valid/unexpired copies of your license, same as drivers license.

If you had a NSA license, and changed it to a SA you had to send the NSA back in. I was confused about that and got some clarification from DPS on that last year.

Re: Additional CHL License
I was aware of that but the post I was responding to stated that you had to return your old license if you changed the address which I believe to be incorrect.clarionite wrote:The modification mentioned there has to do with changing actions, Which isn't specified anymore.jmra wrote:When I moved 5 years ago and applied for an updated CHL with correct address, the instructions I received from DPS was to destroy the original.RoyGBiv wrote:You cannot have 2 valid/unexpired copies of your license, same as drivers license.

Re: Additional CHL License
If that is the case, why does my license issued this month have a " SA catagory"?As of Sept 1, 2013, their is no more "category" of license.

Re: Additional CHL License
Because DPS is still working on modifying the structure of the license to reflect the changes that went into effect last September.

Re: Additional CHL License
You're right. Address changes didn't and still don't require returning your old card. Also, if you renew early and get your new license before the expiration date of the old, you don't have to return the old one.jmra wrote:I was aware of that but the post I was responding to stated that you had to return your old license if you changed the address which I believe to be incorrect.clarionite wrote:The modification mentioned there has to do with changing actions, Which isn't specified anymore.jmra wrote:When I moved 5 years ago and applied for an updated CHL with correct address, the instructions I received from DPS was to destroy the original.RoyGBiv wrote:You cannot have 2 valid/unexpired copies of your license, same as drivers license.

Like george suggested, a reciprocal license is the way to go if you want a backup permission slip.
Re: Additional CHL License
Technically, it's the same as a non-CHL carrying. I'm not sure if a DA outside Travis County would prosecute someone who lost their wallet or left it at home, but the law only gives the 46.15 exception if you're a card carrying CHL.BaleKlocoon wrote:Next question, what is the penalty if a legal CHL holder is caught carrying without his physical license? Re: Additional CHL License
One never had to return a license when one changed address. A modified license was when one changed the category fro NSA to SA. That was how a license was "modified" and required one to return the NSA license.RoyGBiv wrote:Interesting... My above quoted text from 411.184 was from CHL-16, page 13, "Modification". Address changes, renewals, name changes, etc., do not require the return of the license.

TITLE 37 PUBLIC SAFETY AND CORRECTIONS
PART 1 TEXAS DEPARTMENT OF PUBLIC SAFETY
CHAPTER 6 LICENSE TO CARRY HANDGUNS
SUBCHAPTER B ELIGIBILITY AND APPLICATION PROCEDURES
RULE §6.14 Duplicate License
A license holder may not possess more than one license to carry a concealed handgun issued by the department. A license holder who requests a duplicate license based on a change of name or address shall destroy the old license promptly upon receipt of the duplicate license.
Carry without possession of the license is a Class A misdemeanor, a third degree felony if it is place where alcohol is sold or served.Next question, what is the penalty if a legal CHL holder is caught carrying without his physical license? So far I've never done this, but carrying every day with my CHL in my wallet and about 5 days a week without a wallet when I work out, it is bound to happen by mistake eventually.
