Bottom line, LE can ask me any question they want at any time they want. I am free to answer or not, as I see fit.
But when LE threatens to "shoot (me) in the head", they better have RAS or PC or they can expect to hear from my attorney toot sweet and face charges for official oppression and menacing and whatever other laws they actually broke. SCOTUS has already ruled, several times, that the mere presence of a gun does not constitute RAS or PC.

Keep in mind the cop said if the person make a move towards the gun he would shoot him in the head. To me, that is just a fair warning.

I had a cop tell me one time, in a semi-joking way when my car was broken into and I called him to take a report, "if you keep your gun in it's holster, I'll do the same". My response was "Likewise". He gave me a knowing smile and we moved on with my report knowing where we both stood with one another. He wasn't in for taking any junk and neither was I at the moment.

He and got along real well and he dusted for prints and did all he was supposed to do and I appreciated his assistance.

And then later in the encounter a LEO draws his weapon and points it at low ready, in the direction of the OC-er, even though not a single law was broken.

So let us see, if LEO can threaten my life and he is entitled to it. As citizen, I would say the same, Do not touch your rifle and I will not touch mine. The LEO had a full-auto M4 slung, no?

Don't take my comment as advice or a recommendation. You are a free man, do what you want but be prepared to deal with the consequences whether they be bad or good or what you expected or what you didn't expect.

I also don't always take a warning as a threat.

I don't think law enforcement officers are held to the exact same standards as a civilian. As a civilian, we have the option of walking away or even avoiding the situation. A law enforcement officer is duty bound to stand and verify the danger is neutralized. How about when an officer forcefully says, stop or I will shoot? Maybe this officer used a little more "color" than required but he had to be sure this guy got the message. When did we all become so touchy feely about a word? I am beginning to think the libtards and Obama have begun to have more of a sissyfying affect on us all than we thought. We are now gonna nit pick how a cop phrases his intentions if we go for our guns? I suppose I was raised with a little thicker skin than that... but then again... I also don't believe every kid that played soccer in the city league, win or lose, "deserves" a trophy.

Here is my perspective on what the cop said to him. "BooHoo, you hurt my little feelings. I was acting like a total fool and you said a mean thing to me. Boohoo, you said you would shoot me in my whittle head.". That about covers it. :tiphat:

I think there's lots of merit and reality in what you're saying...
Please remember that some of this discussion is about principal... what is right/wrong.
I don't think anyone believes the world is black/white...

As you correctly note, reality and implementation require adults to give and take sometimes to avoid unintended consequences.
