What to Do with Old License

#1

Post by G26ster »

My renewal status says "mailed." My current CHL expires in March. When I get the new one, what do I do with the old still valid one? I know I can't have two valid ones.

Aren't you supposed to return it?

Joking aside, it's odd that the Texas Administrative code only addresses what to do with a duplicate license, and says nothing about what to do with a still valid license upon renewal. Actually I have read on the forum everything from destroy it, to mail it back in, to DPS has no evidence you destroyed it, to..... Guess no one really knows the legal answer.

From the Code:

"A license holder may not possess more than one license to carry a concealed handgun issued by the department. A license holder who requests a duplicate license based on a change of name or address shall destroy the old license promptly upon receipt of the duplicate license."

After recertifing a starr county official back in 2012 : he said "I sure am glad I came to you in Hidalqago county because I have never been explained the law of deadly force and when I could use it" The person only gave him the certificate and recertified him several times in his office with a certificate. ( It was a retired federal agent who is now dead and was a chl instructor)

We have a lot of Dempcrats out there doing what the adminstration (obama) is doing to us..

they fake it

I always destroyed my old CHL once I received the renewal.

That's one of many responses to the question, so please cite the applicable statute that states that the individual must destroy the old license after receiving a re-newed license. I can't find it.

To date I have read on this forum various forms of the two below:

1. You must destroy your old license
2. You must return your old license to DPS

The only statute I can find says:

"A license holder may not possess more than one license to carry a concealed handgun issued by the department. A license holder who requests a duplicate license based on a change of name or address shall destroy the old license promptly upon receipt of the duplicate license."

Common sense says it's one of the two I listed, but I'd like to see the statute with specific guidance, if one actually exists.

Perhaps so. But if it's "policy" as you say, and it requires an action by the CHL holder (to destroy the old license), then it should be published.

it is NOT required to destroy your old license, it is NOT required to return it to DPS, there are no Statues that state this anywhere in Texas Law, nor is it in any of the POLICY for the administration of the CHL. all fat chewing aside, when your new license arrives it has a set of dates that it is valid, so until your old license expires you need to keep it, then put it away in a drawer for posterity because its no longer valid it is expired

I believe you are correct, but my new license, like my old one, has only one date and that is the expiration date. So, as my old one doesn't expire for several months, which one do I carry? This is really confusing :headscratch
