Tom Texan O agree with this Most especially about the part of their possible histories of unable to get a chl...
"I often wonder if these type of people in these videos are too lazy or just don't want to go through the process to get a CHL. Or maybe they are ineligible to get a CHL because of some past history and this is possibly why they advocate so strongly and in such a manner for open carry, just so they can carry a weapon. I really can't imagine anyone that has a CHL going and acting the way those people do and yelling the horrendous obscenities to those DPS troopers the way they did. I know I sure wouldn't. I was brought up much differently than that."

Why open carry when you may Legally carry Concealed???

Never thought about it like that! Maybe we as a gun group should police our own a little... not saying we should say, "no you can't be apart of this because you don't have a CHL" but maybe we should make sure we keep our people some what in line so they don't ruin it for the rest of us. Don't want Billy Bob who has 3 DUI's and a aggravated assault on his record (all recently) going out to be a spokesperson for gun rights.

Re: Two arrested at Austin Capitol during open carry rally
Some of my posts are dead on arrival and others go crazy, hard to tell in advance.
I didn't really express my opinion in the first post, well I sort of did but not really.
So here is my two cents.
I'm not a fan of open carry. It scares people and they vote. I like CHL because essentially everyone can have a gun on them and the BG's don't know who.
That said I would like it if CHL's could carry what I will call "Canadian Mounty holster" where the gun is completely concealed by a leather flap with a snap. That would certainly make concealed carry easier, and it is not as scary. With small guns some might think it was a cell phone carrier.
These guys wanted to be arrested, and not being civil and polite to the police is counterproductive and bone headed wrong. Especially if they are doing what you want.

Amen! I do wish I had the right to carry like Wyatt Earp or any of them in the leather snap holster, that being said I am not sure that I WOULD, but being able to would be nice. I would certainly carry OWB more though.
Re: Two arrested at Austin Capitol during open carry rally
Not to get too far off topic, but I am not a big fan of asking permission to exercise my right of self defense (IE getting a CHL). Ideally, we would all be part of a texasconstitutionalcarry.com website, but sadly that doesn't exist (at least in TX). At least for me, open carry is one of the penultimate ways one can exercise their 2nd Amendment rights as well as their basic human right of self defense. I am not saying that open carry doesn't have its drawbacks, but for me it is an idealogical standpoint. I know that there are many others that, even if open carry were allowed, would still carry concealed. Heck, I still carry concealed (I'm currently living in WA where open carry is 100% legal) even though I don't have to. And I still sucked it up and "asked permission" from the state of Washington to do so.o b juan wrote:Why open carry when you may Legally carry Concealed???
It grinds my gears that I must have to ask permission to exercise both my right to self defense and my uninfringable right to bear arms. We should all get the ability to choose whether or not we open or conceal carry, without asking permission from some government entity. Will people abuse and misuse it? Many will, but the vast majority that choose to, will do so responsibly. I believe that is what our Founding Fathers had in mind. A responsible citizenry taking responsibility for itself and not allowing others to do it for them. And that is why conceal AND open carry should be 110% legal, WITHOUT asking for permission.

Re: Two arrested at Austin Capitol during open carry rally
I carry OWB 90% of the time. With custom Kydex holster for a Pistol with laser/light combo, I could not be happier. I conceal under a light vest. After the new changes of the law of September 1 2013, I am not that worried about printing or if someone can detect that I am carrying. It does not matter anymore.
As for open carry, even when is legal to practice, it is wise to consider when and where to do OC. If you are at work is anyone going to OC for work?!!!
I do support it as matter of principle, however, as CC was passed it needs the right political methodology to happen. Be smart, be strong and you would prevail.

Who's asking permission? Texas is a shall issue state. No one is asking permission. IMHO you are unnecessarily carrying a chip on your shoulder.teraph wrote:Not to get too far off topic, but I am not a big fan of asking permission to exercise my right of self defense (IE getting a CHL). Re: Two arrested at Austin Capitol during open carry rally
Everyone that has a TXCHL has asked permission. Even though Texas is a shall issue state, what did all of us have to go through to get that piece of plastic that, by Texas law, allows us to conceal carry? The fact that TXDPS has the ability to deny us that right means that we asked permission. The fact that we paid the state of Texas for that piece of plastic means we asked permission. The fact that before we received that piece of plastic we would get arrested in public for carrying concealed, means that we asked permission. We asked permission when we offered up all of our information and asked DPS to run their checks, and when we asked DPS to issue us a TXCHL. We should not have to ask for a piece of plastic to conceal or open carry.jmra wrote:Who's asking permission? Texas is a shall issue state. No one is asking permission. Re: Two arrested at Austin Capitol during open carry rally
I couldn't disagree more. By law DPS can not deny me a CHL. That is exactly what "Shall Issue" means. Now if you are upset that a criminal can not get a CHL, then we have nothing to discuss because that argument is asinine.teraph wrote:Everyone that has a TXCHL has asked permission. Re: Two arrested at Austin Capitol during open carry rally
Because we have to be licensed and pay fees, we're all essentially asking permission. He's just providing a nod to the reality of the 2nd amendment in Texas. It's not just an issue of criminality. We shouldn't have to pay or jump through hoops to exercise rights. We pay and jump through hoops to exercise privileges.jmra wrote: Who's asking permission? Texas is a shall issue state. Do you need a license or have to fill out an application to post a political sign? How about to join a church? Those are first amendment rights.
Although I have mixed feelings about open carry, I support the ideology of the constitution, which says I can keep and bear arms.

Re: Two arrested at Austin Capitol during open carry rally
Absolutely incorrect. To suggest that I asked permission in order to obtain my CHL infers that DPS could say no to my application. The fact of the matter is legally they can't. Therefore I did not ask permission. In fact I did just the opposite. By completing my application I demanded that they issue my CHL as they are required to do by law.cb1000rider wrote:Because we have to be licensed and pay fees, we're all essentially asking permission. Re: Two arrested at Austin Capitol during open carry rally
I understand your point. You're saying that the DPS cannot legally refuse to issue unless there the applicant falls into a category where they have the authority to refuse. I get it and don't disagree with that fact.jmra wrote: Absolutely incorrect. To suggest that I asked permission in order to obtain my CHL infers that DPS could say no to my application. Think about my points:
1) A right is something that we are granted. Additional "steps" should not be required. Privileges, such as a drivers license, have strings attached. Does Texas treat the right to carry a firearm like a right or more like a privilege?
2) A fee applies to exercise the right. Even if we don't consider the DPS issuing situation, I've still got to pay want is a non-insignificant amount of money for the training, background check, and fingerprints. The end result is that not everyone can afford to exercise their 2nd amendment right.
Look I'm not saying that Texas shouldn't require background checks and fees for CHL. In terms of practicality, I'm on board. I'm simply saying that viewing it on a constitutional basis, it's not being treated like a fundamental constitutional right. The 2nd amendment, as I think it was intended by the founding fathers, does not exist in Texas.
Re: Two arrested at Austin Capitol during open carry rally

Here's the problem. You're angry about it in a way that leads to the type of protests that do nothing but hurt your cause. If you want to fight for the right to party, you have to use your First Amendment rights properly. Scariung the bejesus out of people and being ornery won't work. Well, it will work in that you'll lose the rights you have just as occurred in CA.
