There seems to be some debate over whether or not the law treats a hotel room as it would your residence. Even the legislature seems to feel like a 30.06 warning would be effective in a hotel room since they passed a law this year (HB 333) on requiring hotels to provide notice on their reservations and in advance so you would know before you arrived. Legislative intent comes into play when the law is not clear, so this could be used against you in a case of a gun in a hotel room.
I would have agreed before that a hotel room was your residence, until this bill was introduced. This law took effect on Sep. 1.

You can have it in your room, you must bring it in inside your luggage. The sign just means you are not allowed to wonder around the hotel with licensed concealed carry. Evidently they do not care about unlicensed concealed carry.

So, point to me a law that says this? 30.06 applies to the premises which includes guest rooms. If you pass that sign, you are in violation of 30.06, even if you could argue that the guest room is a premises under your control. And, there is no law that I am aware of that specifically gives an exemption to 30.06 if the gun is in your suitcase.MeMelYup wrote:You can have it in your room, you must bring it in inside your luggage. IMHO, there is an issue even larger than the Hilton Hotel chain posting some of their properties. They don't want me to conceal carry and legally post it, fine. I take my business elsewhere. A larger issue is that they are not posting this sign at all entrances and are inconsistent at best about which locations are posted. A third issue is that the lettering with the glass as a background seems questionable. It could be easily overlooked depending on the direction of the sun and any glare off that window.
Not knowing about how they run their internal management, we may or may not be experiencing a situation that is left up to the individual location heads. I am normally one of those folks who don't like to educate businesses that are improperly posted because I will carry right past them. In this case, I am wondering if we could get some clarifications from them on their policy. If they are anti gun, I feel I must question why my donations(very large I might add) to the NRA have been spent to hold an event at this place.

I want to add this, you MIGHT be able to pass the standards in 46.02 if you disarmed, checked in, then went back to your vehicle and went directly to your room. Same going back out, you would have to go directly to your vehicle, then disarm and come back in to check out at the desk. The Hilton Americas (downtown Houston, across from the GRB) has been 30.06 posted for awhile. I remember going to a tradeshow there around 4 years ago and I was staying there. I did not notice the 30.06 until the last or next to last day of my stay. It's what I call "sneakily" posted. I would take the 2nd floor crossover to the GRB and I remember seeing the frosted lettering on the glass, off to the side, when I would come back from the GRB in the afternoon, it was pretty hard to see from what I recall. I believe they also had one posted on the entrance right below it (like mentioned in a post on here) and I think I recall eventually seeing it somewhere near the front door, but it was not plainly visible, you really had to look for it, and then you had to look for it again. I now stay at the Embassy Suites caddy corner from them, yes, part of the Hilton chain but I have not seen a 30.06 there...and if y'all have seen one, don't let me know!

I have an upcoming reservation at a Hilton property. I have received no notice from them about a 30.06 sign. Has anyone else? Is there recourse on that?
The reservation was made prior to 9/1, but the actual stay wouldn't be until October.

If so, why would they?
Unless this a practice I've never heard of...?
To my knowledge, businesses only 'notify' by signage.

Sec. 2155.103. NOTICE REGARDING FIREARMS POLICY. (a) A hotel shall include on the hotel's Internet reservation website the hotel's policy regarding the possession, storage, and transportation of firearms.
(b) If a hotel provides a written confirmation or a written statement of terms and conditions to a consumer after accepting the consumer's hotel reservation by telephone, the hotel shall include information specifying how the consumer may review applicable guest policies. The guest policies must indicate the hotel's policy regarding the possession, storage, and transportation of firearms by guests.
(c) A hotel owner or keeper commits an offense if the person does not comply with this section. An offense under this subsection is a misdemeanor punishable by a fine of not more than $100.

30.06 postings only apply to people licensed to carry under Texas H 411, right? So is this one of those odd situations where CHL holders have fewer rights than non-CHL holders in Texas?
I remember a few years ago taking some firearms into a hotel in Dallas (prior to having my CHL). As far as I know I was within the law.
BTW, I can confirm the Hilton in Austin is posted with (what seems to my eye) a valid 30.06 sign on the front entrance on the south entrance.
