The grace period will probably continue until some anti-gun group or politician sues DPS. Or get the AG to issue an opinion.

18 years from now they will say they misunderstood the law and enforce it....

UGH! The reason why I called was I had a student in that condition...expired in March. I was told clearly grace period will continue. So he calls them (he just let me know) as they told me he needed to, and this person tells him there is no grace period, he now needs an original. The left hand does not know what the right hand is doing. We MUST have a definitive answer from them.

100% absolute certain, renewals will still have a one year grace period. I have better sources than anyone here, including Mr Cotton.

CHL instructors will soon have to take a renewal class. I spect this will be one of the topics covered. Since I was told today that yes, there is still the grace period, I will go with that till I hear otherwise. But before we can just accept your word, we need to know source of confirmation?

Sec. 411.185. LICENSE RENEWAL PROCEDURE. (a) To renew a license, a license holder must, on or before the date the license expires, submit to the department by mail or...
The underlined text was specifically added to the bill's modification of the existing code. I claim no secret sources that know, but I'm having a hard time seeing how on earth DPS could get around that in order to create a grace period for renewals. I mean, how much clearer could legislative intent be made? The underlined text simply did not exist but was written and inserted and debated and voted on and recorded as law. If they meant something other than "on or before the date the license expires", one could imagine a few different words they might have used.

Or gosh, maybe just not have gone to the effort to add those new words to the law?

But, I am not a lawyer, a legislator, nor do I know the secret handshake that would allow me to be 100% certain that the words specifically inserted into the law don't actually mean what they say.

Sigh.

I'm not here to talk about what the law does or doesn't say.. Nor am I trying to say what "ought to be or not". What I am saying is that DPS is renewing persons licenses who are within the one year grace period, just like before. There's many persons on this forum telling people otherwise & it's giving false advise. I gaurantee if someone is within their one year grace period & sends their documents/fees right now their licenses will get renewed. Again, not saying what ought to be, I'm saying flat out what IS.

I had an e-mail inquiry about a renewal class from a gentleman this week whose license had expired in July. In light of the issues, I suggested he just contact DPS directly and see if he could get a current answer straight from the horses's mouth. Below is a paste directly from his e-mail late yesterday:

"I called and they said that the law no longer requires the renewal class so I just need to complete the online application and mail in the check list with barcode that was printed when the application was completed... The checklist asks for CHL - 100 Certificate of Training. I told him that it was asking and his response was yes sir, but the law no longer requires a renewal class... So I said all I need to do is mail this page and he said yes sir..."

I see no down side to trying to renew late. If the DPS software allows/accepts you payment (at the 50% discount), you should be good to go.

If they want a new CHL-100 and prints, they will write you.

I doubt it would delay your license being issued by much. Especially since they are issuing license w/i a month now instead of taking 6 months to a year.

But what is the source of said guarantee? Some call DPS and are told NO grace period (including some of my students) while others are told yes. Sounds like right hand don't know what the left is doing. Our "false advice" is only because this is what we were told only last month.

We should advise our clients to renew before their CHL expires, at least 30 days. They should get their new license before their birthday. That way, there will be no lapse in ability to concealed carry.

If they procrastinate, they should still attempt to renew. (I would NOT call DPS and ask, just do it.) At some point, someone may decide that they have to follow the law. Then, they will write the renewals that were late and charge them for an initial license (if there is an increase) and require a CHL 100 and prints.
