I don't even understand why this is a problem with modern automobiles. When I exit my truck to fuel, the only door that unlocks is the drivers door. I believe most newer vehicles can be user programmed for what doors are locked/unlocked based on certain actions by the driver (gear selector moved from drive to park or how many times the unlock button is hit, etc.).
When I set the pump to start fueling I walk back and forth between the pump handle and the front of the truck observing my surroundings (out of boredom more than anything else). If I have to leave the truck for some reason, I hit the lock button on the remote locking the drivers door which would be the only door unlocked.
In most cases I think people become a target primarily because they made themselves a target by failing to do the most basic things to ensure their safety and security.

As I've said many times, we're never more vulnerable than when we are bent over pumping ethyl, loading stuff in the trunk or loading the kids in their seats, etc.

The idea behind the deadly force justification for burglary at night comes from the idea that during the daytime, it's easier to observe the thief & determine by observation whether they intend something other than simple burglary. At night, such observation would be limited. But rather than put the onus on the victim, our legislature (rightly) removed a possible loophole from the defense.

As far as the rest of the hyperbole that this thread has generated, I would think that taking a simple extra measure of locking your car doors & being aware of your surroundings would be well worth the expense, time, & tremendous personal disruption that dispensing sidewalk justice would result in.

Sidewalk Justice? Justice is justice. Why should I have to worry about anything since I have broken no laws? Why do Criminals have more rights than those who are not? Or perhaps, why are criminals protected? Horse thieves, chicken thieves and cattle rustlers were hanged for a reason. Property, Self Preservation (defense) and Liberty are those reasons. Those three things cannot stand alone or in pairs. One cannot exist without the other two. Two cannot exist without the last. Its all three or tyranny reigns. These three things are the basis of Law.

Who am I to judge if a woman's purse that contains money from her labor to feed her children is worth the life of a Criminal Thug who wishes to steal it in daylight or darkness? Who decides this? A Politician? A Mayor? You? Me? The Majority? Not our decision to make if justice will reign over all. It appears we have become very liberal with other peoples Property and Natural Right to exist. How about we stop imposing personal beliefs with the Mob Rule of Man and adopt the Rule of Law in this Republic as intended?

Because we visit multiple States (we just came back from a trip through OK, KS, NE, SD,WY), I've adapted a very generic approach to deadly force. The laws in all of the different States are very different and I have no intention of spending my retirement funds defending a shooting if there is any other possible way to deal with the matter.

I assume that my stuff is vulnerable all the time to a smash and grab. I've pulled into gas stations on trips and had someone in my face before I could shut off the engine. Typically, I survey my surroundings before I ever get out of the vehicle but the last few seconds of my approach to the gas pumps are usually taken by making sure that I'm not going to run into something. My solution is to have my things covered and out of the way before I have to stop. I know that thieves are a lot more creative that I'll ever be so the idea is to make sure that they don't get a chance to exercise their creativity. The closest that I've every come to using DF was in a truck stop in MS where I'm sure that I was being "interviewed" while I was pumping fuel and had limited opportunity for retreat without abandoning my wife. I agree with Old Gringo that gas stations are a great place for nefarious activity. If more people felt that way, they won't be.

This is what I do. While fueling my vehicle, I am very aware of what is around me... And whom is around my space.

Now if we are talking "little hamburgers" I have absolutely no control at all.

The current law (as enacted by elected representation) in Texas states that burglary during the day does not justify the use of deadly force. It doesn't change because you say it does. There was a time when stealing a horse was a quasi capital offense. That was because at that time in the remote areas of the country, not having a horse could put a man in a life or death situation. Stealing other livestock or other property was never treated as such.

Looking at this from a "can I shoot" perspective is very limiting. There are a lot more options available with a "what can I do to prevent this from happening" approach. If you don't keep valuable easily accessible & lock your doors, "can I shoot" doesn't even come into play.

Burglary does not have a distinction between daytime and nighttime. 9.42 only adds the nighttime restriction to theft and criminal mischief. Arson, burglary, robbery, and aggravated robbery do not have such a restriction.

I am sorry, but the mantra about situational awareness applies.

If someone is hanging around a pump, I generally avoid pulling up in the first place. If someone approaches my car I am aware of it and take proactive action. Just the fact that you make eye-contact and move between them and your vehicle is usually enough to tell a lazy-puke that steals for a living to leave and find some other easier mark.

In order to get out of the quagmire of minutia (burglary vs robbery vs theft vs etc), I suggest that this discussion would be much more beneficial if we took a step away from what you can legally do and take two steps toward what you should do. My carrying mindset is based on drawing and firing as an absolute last resort. If I can take an action or several that can keep me out of that last resort, you can bet your last dollar that that's what I'm gonna do.

Yeah... When it comes to actions (especially ones that can't be undone), "should" is a far wiser question than "could".

Effective 1-September, the intentional display of a handgun has a new friend in the recently enacted SB-299.
On that date it it will be a defense to prosecution to display a handgun in situations where "use of force or deadly force" would have been justified.
Previously, the intentional display of a handgun was limited to "deadly force" situations only.

I am considering recalibrating my "when to draw" mindset in light of this change in law.

I can see the importance in "Should" compared to "Can" but the reality is the more you know about "Can" helps you to make that split second decision about whether you "Should" they do go hand in hand.

I certainly agree with most of the writings in this post as most are very logical. I am not paranoid but I also am very aware of things around me. I still look at rooftops, buildings, houses, bushes or anyplace a sniper could hide. If a car is passing me on the highway I watch the window and if by some chance that window starts rolling down as its passing me I take evasive action. I have an M4 Bushmaster mounted in gun grips on my tractor when I'm in the pastures and scrutinize all of the heavy vegetation areas along some fence lines and watch my LGD's actions closely. I watch the rare truck that passes my house until its out of site....Oh goodness. I"M PARANOID!!

The written Law of Man has sure gone astray from State to State and no State has the right to take away the most basic right to exist and just because we have allowed Man to do this by the "inaction of Society" and the "inaction of the Federal Government" to uphold the Constitution doesn't make it right. I think it's absurd we have to have a State Law enacted that specifically gives Free Men the right to exist. That my friend is lunacy. A complete perversion of Justice and Freedom.

My SIL has parents that live in Paradise. I don't know if you are joking with all the scouting of the enemy stronghold stuff you listed but I do have a good story for you. My SIL's dad was telling me that his neighbor caught a couple meth freaks stealing some kind of fertilizer he had stored. Maybe it was fertilizer, it was some kind of farm chemical the meth heads use to make meth. Anyway, he called the sheriff and apparently some kind of chase started. The meth heads ran off the road at a curve and drove their car into a tree. One of them could not get away but the other took off running and left his dope head buddy behind. They eventually caught the guy that got away. They were both well armed! The point is, even in rural communities, there is danger now from the growing drug epidemic that has engulfed our country. These meth making scum are not in their right minds. So even in Paradise, you folks have to be aware of what is going on around you.

His folks have lived out there for years. They have a small place, around fifty acres. Good people. Paradise is a nice place by the way. I have been out there with them a time or two and it was nice getting away from the big city.

Like I said, I don't know if you were joking but I personally would carry a long gun and side arm with me if I were working out in the fields. Even in paradise. Mostly to protect myself from the meth making scum and the type of scum they attract.
