Army Corp of Engineers/State Parks question

#1

Post by sfemti33 »

I have a question about ACOE land and state parks. Forgive me if this is an obvious answer, but I am fairly new to Texas and use of public lands. I am planning on taking my family to Eisenhower State Park in Denison and camping for a day. I have read some older stories stating this area used to be ACOE land but may have been leased back to the state. There is some conflicting information out there and so far calling the parks system has been fruitless. Can anyone tell me if it is ACOE land or if I am okay to carry there? Their website only mentions displaying a weapon (from state law) but nothing else points me to my answer. If you wouldn't mind pointing me in the right direction, it would be appreciated.

Excellent question. IMHO you would be good in the campground since it is a Texas State Park. It was originally ACOE but leased back in 1954. Now, on the lake which is ACOE and in the nearby Hagerman Wildlife Refuge (Federal property) would be another matter.

I would carry quietly in the campground.

Technically if it is "leased" back it is still corps property.

I know there is a rule around Lake Texoma that you cannot build within 100 feet of the waterline (if you own property). I would treat that as a guideline for where you can carry as well. But then again, if you are on ACOE leased property, you might not want to do that either.

Eisenhower is Federally owned - USACE managed, leased to TPWD. There is no truth in the two feet of free board above pool being the limit of Corps fee lands.

I’ve contacted my State Rep, Gary Elkins, about co-sponsoring HB560. Have you contacted your Rep?

Maybe a call to the front gate and asking would yield the answer.

Although Chief Judge Winmill granted a permanent injunction enjoining the enforcement of the regulation, the scope of the injunction is limited to Idaho because the plaintiffs' allegations are limited to Corps' property in Idaho. The case is Morris v. U.S. Army Corps of Engineers, No. 3:13-CV-00336-BLW (D. Idaho Oct. 13, 2014).
