Understanding 3142
IF 3142 is signed, I am interested in other opinions regarding current NSA holders. My opinion is that since the wording regarding "carrying out of class" is being removed, that the change, in effect, grandfathers current NSA's to being legal carrying SA. It also modifies the CHL itself (411.179) to remove the SA / NSA indicators. This would in effect eventually take the designator off of every license upon renewal, modification, or replacement.
If it is not vetoed......
How do the legal minds on the forum see this? How far off am I?

That is a good question. Some staff at DPS may be scratchin their head over such right now. Or if not, they need to.
Although I don't think there are all that many NSA licenses out there. Since the inception of the program, I've had maybe 7 students go for the NSA only. But with the law change, I do think many more will opt to shoot with a revolver.

I guess I just do not see it as very complicated.
It seems in my non-lawyer mind to be moving more toward the constitutional
writing of "shall not be infringed". It seems to be clear.
Want to carry a revolver, or semi, it's not the business of the state.
Whatever you want to carry..... you should just be accurate with it.
I think that's all I read into it.

I guess technically since it went to Perry on the last day of the session (5/27) he has 20 days to either sign, veto, or let it become law without his signature.

Technically, the NSA restriction would be invalid after 9/1 BUT some LEO may not know that. I assume the CHL could ask DPS to reissue his license since new licenses will not specify SA/NSA.
Course, the few that have NSA licenses probably do not have/will not carry SA, so the question is moot. :)

I sent an email to DPS on June 4 asking this question:
Answer:With the change by HB 3142, will all existing NSA licenses automatically allow the holder to carry either SA or NSA after this becomes effective?
Or, does this only apply to license issued after the effective date of the change?
HB 3142 states the changes affect a license issued on or after the effective date. I just checked and it does not appear to have been signed by the Governor at this time. Once it has been signed, the effective date is noted as September 1, 2013.

I believe they did not give you the correct effective date. The bill received the required votes to override the constitutional 90 day requirement and should take effect upon signature.

3142 was signed by the governor on 6/14/13 and took effect immediately upon his signature.
In my mind, it eliminates the entire concept of "class and category" from the CHL vernacular for all parties.
Is it just a matter being sure that students understand the concept no longer applies (at least until a new CHL-16 is released), or can anyone think of specific issues we should be sure to cover?

So since it's effective as of June 14, that would mean that any proficiency tests given as of now could be any category handgun? The current CHL-100 would need to be revised with no category information needed (except for instructor proficiency tests, which is a whole other ball of wax). Also, licenses issued based on that would no longer have category listed on them. I don't think those things will happen "over night".

I'll go ahead and indicate SA or NSA on the CHL-100, as appropriate. It won't have any real-world meaning, but until the form is revised, I don't suppose we should just ignore it. My $.02, anyway.

I imagine that DPS will still require the entry for now. However, even if a student wants to qualify NSA and it gets out on the license, then it won't matter anyway, they can carry whatever they want.

This is what I have never understood why the CHL Regulatory Lic. Service never advisies the instructors of any changesw that are here or are coming down the pike.
They have our email, PO Box, and tel #.
If I hadnt found this place a few months back I would be in the dark..
And I have been certified since August 1995.

o b juan - you have now joined many of us that are frustrated by the lack of timely information coming directly to us from DPS.
