Both carry under CHL and MPA is being discussed in this thread, hence my use of the words "confusing language in this thread" :tiphat:

Additionally the OP stated he is set to receive his CHL in the mail.. Further encouraging me to get the clear requirement to inform if carrying under CHL in this thread. No harm, no foul intended,, if it is knowledge YOU do not need, throw it away.. Perhaps it will help someone though. :cheers2:
What I was trying to convey earlier (and clearly not succeeding) is that there is no requirement to tell the officer you have a weapon. If he asks, then yes, you should tell him. There are a lot of folks on here and elsewhere who will show their CHL whether carrying or not. I am one of them. However, I am of the opinion that doing that is sufficient. If the officer wants to know more he will ask.
Im not positive.. But I think I disagree :smilelol5:

You DO have a requirement to tell the LEO if you are carrying under a CHL once he has asked for ID.. Point is he asked for ID.. not if he asks about a weapon,,,which may or may not come next..

But normally the first thing in my experience the very first thing they do upon making contact, is, "Sir, may I have your license,. Registration and proof of insurance?" . From that second on, you MUST inform him, by way of providing your CHL.. That was my point... You can not wait till he asks about a weapon.

Perhaps we are stating the same thing and Im just missing it.. If so, please excuse my confusion. :tiphat:

A slight correction. If I have a handgun on/about my person, I'm required to display my CHL along with my ID when a peace officer or magistrate demands ID. I'm not required to volunteer information about firearms or other weapons. Technically, I'm not even required to answer questions about the location and number of firearms within reach, as long as I don't lie, but that could be a stupid decision in practice even though legal.

Absolutely.. correct.. Thanks

I was under the assumption here in the Texas Concealed Handgun forum and this thread specifically it was a given we were discussing handguns carried under the provisions of MPA and CHL. :tiphat:

I could have been more detailed in my response to make that clear.. :thumbs2:

Sure but the crazy thing is someone who hasn't passed the CHL background check and is carrying under MPA isn't required to tell the cops anything about weapons in their car. As long as they don't lie.

Even crazier, felons carrying illegally are allowed to lie because they can't be required to incriminate themselves.

I think we are sort of on the same page. Yes, you MUST show him your CHL along with your TDL if you are carrying. There is no need to say anything, particularly about a weapon. If he wants details he can ask and you should answer, but there is no requirement to tell him up front. The fact that so many CHLers always show their CHL means that the officer can't assume that the person is carrying just because they showed him a CHL. Of course, if you don't show it, then they are going to wonder why not once they run your license and may want to find out more at that point. Also, thanks to MPA, they have to assume that all drivers are armed. In all cases, I believe it best to not offer up the information until asked. By information, I mean regarding a weapon, not the CHL itself.

That's the way I understand it. Just because I have a CHL does not mean I have to tell an officer I have a firearm in my vehicle or on my persons. I do have to give him my CHL if I am carrying a firearm. If he asks if I am carrying, then I will tell him.

I have rehearsed this in my mind a bunch:

1. I have been lite up
2. slow down and make my way to a safe place to pull over
3. Push the button to lower the rear window sun screen (cops can't see in through this)
4. Turn on the video and audio record of my phone
5. Pull over and turn on my hazards and interior light if needed
6. Turn off the car
7. Pull out my DL, CHL and insurance card
8. Roll down the window
9. Have them in my left hand with both hands on the wheel
10. Wait for instructions from the officer

Nowhere do I tell the officer about any firearms in my possession.
My guess is that lowering the screen after you've been lit up will only make him think you are either hiding something or getting a weapon out.... just a lay perspective but I would expect to be met by an "excited" officer on your stop. Around here your #3 might cause an officer to draw his weapon and make #10 begin with "exit the car with your hands up!"

Not something I would do for sure! I like #4 but think #3 is a problem.

It appears you aren't familiar with how the sunscreens work. Lowering it removes it from shading the window. That way, the cop can see in.

You were legally in the right, of course. I'm just a firm believer in not arguing/disagreeing with LEOs unless absolutely necessary. In this case, a simple "thank you for the clarification, officer" might have diffused a potentially disastrous encounter. Then just file a complaint with the department after the fact.
Yes, kowtow to facists. I will respect de authoritay, BUT I will respect even more ppl like eric scott, who has shed light on the murky world of corrupt, power tripping cops. If the OP want 2 b the next eric scott, I won't stop him, I will repect him 1 million time more than the cop.

Yes, correct. Maybe I was not clear. I drive with it up so you cannot see in to the car from the back. I will lower it so the LEO can see in.
