It looks like school administrations that care about the children already have the power to opt in and make it legal to carry at their schools. They don't have to wait until 9/1/2013 or 9/1/2015 or even later for the legislature to change the law.
I sincerely apologize to anybody I offended by suggesting the Second Amendment also applies to The People who don't work for the government.

Does anyone know the legal basis by which Harrold ISD, or any other Texas ISD, can allow their teachers and staff
to pack while at work?

What's the statute that enables this?

2nd Saturdays: Rudy's BBQ, N. Dallas Pkwy, N.bound, N. of Main St., Frisco.
3rd Saturdays: Golden Corral, 465 E. I-20, Collins St exit, Arlington.
4th Saturdays: Sunny St. Cafe, off I-20, Exit 415, Mikus Rd, Willow Park.

(1) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution;

That is correct. If a school wants to allow CHL holders to carry inside buildings, they already have that power in the current law. Also, it's legal to carry in vehicles in school parking lots, and on campus if you stay outside building, except for private schools that give valid 30.06 notice.

I will be contacting my school districts superintendent this next week regarding this.


Even if the schools recruit a half dozen teachers that choose to be on the armed first responder crew it will be 100% better than what they have now.

Sure wish my district would go that route. Doubt that it'll ever happen though.

I had found out about this several weeks ago when a discussion about guns/schools arose. About that time I had decided to work on getting my CHL. I found forums such as this, few others, learning about which weapon to carry, how to, laws, ect. During all that time, I have been told, read, heard, then taught(CHL class this weekend) that guns & schools are not to mix. The only info I could find on Harrold ISD were old 2008/2009 news articles, then this new article. I was talking with a local LEO who works at a high school off-duty. He told me there was a "discussion" about the school getting some kind of safe with firearms that could be available in case of a Columbine type incident. The supt said "that could not be done because TEA would ot allow it." My point, I guess, is that I find it interesting that the State of Texas does give the leeway to allow schools to make that decision, and it seems like it is top secret....maybe not so much now.... :txflag:

Yep, you are correct that individual districts make the decision. The TEA has nothing to say in the district decision in terms of legality.

Thank you for your response. It's nice that that the law already clearly allows heat to be packed if allowed by school policy.

We have to think about training those teachers with CHL's how to react and respond to a school shooting. Schools practice fire drill, tornado drills... but not lock-downs (not as much as it should be done). This is an example of how one school reacted:

Harrold ISD has their teachers undergo extensive training and psychiatric evaluations to ensure they are prepared and not "losing it" (teacher do have a lot of stress during the school year). It's more than just law and district policies, too. Getting the community supporting the idea of guns in the school is an absolute must! The Harrold ISD parents support the idea of guns in their school, and they have good reason. The idea might not work so well in large districts with SRO's or security in the building. They're already present, and presence is a deterrence.

The school district where my wife teaches practices lock-downs on a regular basis. I know she and several of her co-workers would welcome a change in policy regarding arming of teachers and staff who hold CHLs.
