He had time to try to warn her away and fire 5 rounds but not time to step out of the way? Doesn't make a ton of sense unless she was gunning for him.
Would love to hear the whole story here.

It is a shame that she had to die, but her husband is something else...
"Where's the evidence that my wife threatened a trained officer?"
How about that border patrol agent shaped dent on her hood and windshield???![banghead :banghead:](./images/smilies/banghead.gif)

Re: CA woman fatally shot after allegedly driving into borde
I agree with the last poster that this whole story makes no sense whatsoever. Just a few questions that I would like to see answered:
How did he end up on her hood in the first place?
Why was he in plain clothes if he was there in an official capacity?
How was he unable to get out of the way?
After somehow finding himself on the hood of a moving vehicle, why did he feel that it was safer to take one hand off the hood, draw his weapon, and kill the driver of a moving vehicle as opposed to trying to roll off the hood?
Definitely not enough info to go on here. On the one hand if she intentionally hit him by veering off the road, etc., then I would probably say he is in the right, but if he did something like stand in front of her car, in plain clothes, and try to keep her from leaving, that's another story altogether.

According to the video segments he was in plain clothes as part of an undercover operation to serve a felony warrant to someone in that area, when the woman supposedly struck him with her car lodging him in the windshield. She drove with him on her hood for several hundred yards before he opened fire.
I would have probably reacted the same way if i was stuck on the hood of a moving vehicle.

Why would turning a car into an uncontrollable motorized ball of glass & steel be a good idea? I realize he wanted to get off, but it seems like his "solution" couldn't have improved the situation.
I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.
Re: CA woman fatally shot after allegedly driving into borde
I agree that the situation could have been alot worse if she died with her foot on the gas pedal. But lets assume that the reports are true and she did ram him with her car, in that case her intentions are clear that she wanted to do bodily harm to him and that if he rolled off of a moving car there is a good chance he could be incapacitated and all she would have had to do was throw the car in reverse and finish the job.Dave2 wrote:Why would turning a car into an uncontrollable motorized ball of glass & steel be a good idea? Also, throwing yourself off a moving vehicle is a terrifying prospect not many people are willing to do. Keep in mind this probably all happened in a matter of seconds, and in those few seconds the agent was probably in a state of pure panic where he reacted the way he was trained to... draw and stop the threat.
Imagine yourself in this scenario... You are sitting in your favorite couch watching that amazing new show and you suddenly feel a tickle on your leg. You look down and see a <insert name of most feared creepy crawly> crawling/slithering/sliming its way up your leg. Do you:
A) Locate the nearest trash recepticle, verify that the area around the trash recpticle is clear, and calculate the proper velocity and trajectory needed to launch said creepy crawly into the recepticle....
Or. ..
B) Start kicking your leg manically all the while screaming "Get it off me!" and after the creepy crawly is sent flying across the room will you locate the nearest creepy crawly killer and embark on a search and destroy mission.
I'm willing to bet most people will choose B or a variation of it. Most people will just react when in a panic state and most of the time that reaction will be "Whatever I can do to stop the threat now!"

I would think if it were me and I found myself with any armed person on my hood that as soon as they drew their weapon and pointed it through the windshield at my head/face, I'd quickly find the brakes sending them sailing off. But, I have been accused of having intelligence (not much) at various times in my life. She, apparently, not so much. Her husband, not so much. They reproduced 5 times? Darwin must be working double-over-time trying to keep up with the litters of future award recipients.

This happened over in Chula Vista, across the bay not far from here, and just north of the Costco I shop at often.
As is not uncommon in these situations, there is some doubt raised by the family and witnesses, none of whom appear to have seen the entire event from news accounts released thus far.
It is odd, though. As far as has been reported, this woman does not appear to have been involved in any law enforcement connection. The felon who was sought is apparently not her husband, but we don't know what if any relationship there may have been between that felon and this woman.
Could this have been a poor reaction to seeing an armed man in plainclothes in front of the car, and panicking? This isn't Texas. Many people have never seen a gun in the hands of anyone other than a LEO, or a gang banger, perhaps. It is hard to figure how she could have gone "a couple of hundred yards" in that neighborhood with the officer on the hood.
Border Patrol units are everywhere here, more common than police units actually, as we are a few miles from the border. So are Baja CA license plates!

Remember the old guy who drove through the farmers market? Its not unheard of for somebody panicked to have the gas pedal reaction.JALLEN wrote: Could this have been a poor reaction to seeing an armed man in plainclothes in front of the car, and panicking? I'm sure she had a good reason. The officer obviously did nothing to minimize the risk. We should train these officers to be more caring and make more of an effort to defuse these situations. After all, he is a trained LEO against a poor defenseless woman.

Re: CA woman fatally shot after allegedly driving into borde
Sounds like it would have been a hit and run, she had no intention of stopping. It reminds me of the woman that hit the bum and drove home with him still in the windshield. Parked in her garage and listen to him dyeing for two days

Re: CA woman fatally shot after allegedly driving into borde
The news here tonight is that the agents were looking for a convict in an apartment. According to 2 witnesses, the woman was IN the apartment, and walked out passed the agents, and got in her car. The agent followed her demanding she talk to him, stop, etc. He was standing near the front of the car, with his foot in front of the left front tire and attempted to stop her from leaving. The reason she may have wanted to leave was that she was on probation for a drug related beef a year ago. The apartment is not where she lived, a party apartment with a "lot of traffic" per one witness.

Well, another example of someone failing to observe the "Iron Triangle": don't go stupid places with stupid people doing stupid things.JALLEN wrote:The news here tonight is that the agents were looking for a convict in an apartment.
