A question came up on another forum I frequent:
Is the citizenship of a Texas CHL holder somehow encoded on the card? A Texas CHL can be issued to legal permanent residents who are citizens of other countries, but under Texas law a CHL is sufficient ID to vote with. How does a poll worker tell by looking at a Texas CHL whether or not the holder is a U. S. citizen?

I think the OP is refering to the voter ID law that is currently being contested in federal courts in order to set it in place. Under the Voter ID law a CHL would have been an acceptable form of ID for voting. The answer is that citizenzhip is not encoded on our DL or CHL, however you can not vote unless you are registered to vote and illegals are not able to register as themselves "in theory".

I do not believe citizenship is indicated on the state ID, DL, or CHL. Another form of ID is a student ID, I have not attended school in TX and do not know if it shown. I cannot remember ever having to prove my citizenship when registering to vote in FL, VA, MD, GA, MA, or TX.

When I vote, I show ID, they compare it to a list of registered voters that are supposed to vote at that location, and place a stamp next to my name as well as my VR card, if'n I am not mistaken. If you are not registered to vote in that district, your name is not on that list, and you are not allowed to vote there, so one's citizenship doesn't need to be encoded on the CHL any more than it does on ones DL. I forgot to update my voter registration after I moved from Duncanville to Dallas, and had to drive in rush hour back to Duncanville, barely getting there before the polls closed.

I thought they'd always let you vote on a "provisional" ballot. No?

Another form of ID besides my old student ID is my County Government issued Library card with my photo on it ... but they aren't acceptable for voting I don't believe, and my Justice League of America membership card doesn't have my photo nor prove I have super powers so they don't accept it either.

One must have 1) a voter's Registration card AND 2) an accepted Voter ID
As they look me up on the computer sheets after I hand them my Voter Registration card, each time they say "Oh, there's a note on the computer printout sheet says 'driver's license,'" so I've had to show it for at least since 2005. No idea why.

Perhaps you should just tell them you're Eric Holder -- that always works without ID. :evil2:

Yes you have to be registered to vote. You don't necessarily need your registration card with you to vote. You can show your DL instead.

If you have your VR card there is no reason to ask you for ID. There are situations where it can be required but only if it comes up on their computer for some problem. My brother just went through this. He assisted my 90 year old mother voting and a poll watcher came over and was looking over their shoulders as they voted and made a comment to them about how they were voting. He complained to the people at the polling place (later made a formal complaint to the clerk). When he went to back to vote for himself the lady gave him problems, telling him specifically he was required to show his TDL, even though he had his VR card. When he filed his complaint he had his status checked and the clerk told him he was in the system and shouldn't have been required to show any ID. She also said that they can't ask specifically for TDL anyway, only some form of ID.

As I understand it, you do not need to be a citizen to obtain a Texas DL. You can then use a Texas DL to register to vote. You then use the DL as ID when you vote . If this is true, then the voter ID laws will stop nothing. The deception takes place when registering to vote. :confused5

Given that, I don't understand how a non-citizen would get on the voter rolls. I suppose it is possible, but not likely.

When I used to work retail not to long ago, people trying to pass bad checks and return stolen items would use Texas IDs and NOT Texas DLs. Our store made it policy to require DLs and not IDs, but that didn't stop some of the other workers who didn't care from accepting the IDs. I wonder why the scammers used IDs instead of DLs. There must be a reason. Easier to obtain fraudulently perhaps?

My ex girlfriend had someone else using her Social Security Number, so she had to get a new one.
My deceased dad was on the voter rolls in 11-2008; he passed away in 9-2008 ... people can pretty easily get lists/obituaries of recently deceased and if no ID was required .. Hi, I'm xxxx xxxxx here to vote (again under this other name) I didn't bring my voter reg card, you can look me up on the computer sheet, yes, I'm still at XXXXXXXXXXaddressxxxxxxxx

That's why government issued photo ID should be required.

You have to provide evidence of your citizenship or legal immigration status to get a DL or a CCW, and you can register to vote with either of those under the not-yet-implemented Texas law. Obviously DPS records the citizenship status of the license holder and can provide it on request to the voter registrar, but I was wondering if that info was encoded in some manner on the card itself. Apparently not.
