Pleasure Pier Galveston

#1

Post by Katygunnut »

I'm thinking about checking it out this weekend.

Does anyone know whether this attraction is properly posted with valid / enforcable 30-06 notification signs? It's owned by the same folks that own Kemah, so I'm guessing it should be fine, but I wanted to check here first.

No signs that apply to a CHL holder. I checked yesterday.

They prohibit bringing in alcoholic beverages. I think that's the only sign of any sort. They have a few non-commissioned security people who can barely make eye contact with the crowd of people coming in.

Thanks.

Given the location, I don't think I would feel comfortable being there with my kids and no gun. You saved me the potential disappointment of driving all the way there and then turning around and leaving.

Location is fine. There is a parking lot across the street with good views and you get validated if you eat at the restaraunts. I would have no qualms during the day going there unarmed. However i go almost nowhere unarmed so it is moot. We went Friday night and it was pleasant. My LEO sister was with us. i asked if she was armed and was told "No, but I know you are and are a better shot and I have my badge. Team effort".

Pardon my ignorance, but does this not count as an amusement park? Are they not prohibited or am I confused? :confused5

By defination an official "Amusement Park" has a long diefinition & has to be posted. It ma be an amusement park but not one that is statitorily off limits to carry.

I believe Sea World & 6 Flags are the only 2 that are off limits.

Thanks! So many rules, such limited memory storage sometimes. :tiphat:

The amusement park clause of PC 46.035(f)(1) has these two odd conditions:
"Amusement park" means a ... facility or park where amusement rides are available for use by the public that is located in a county with a population of more than one million, encompasses at least 75 acres in surface area,...
Galveston County has fewer than 1 million population, and the Pleasure Pier is less than 75 acres (it's more like 3 acres). So even if this section were still in effect, it would not apply to the Pleasure Pier or the Kemah Boardwalk.

It was actually tailored to Six Flags in Houston, which at the time was the only place that met these conditions.

Nothing in Galveston that a visitor would go to has a valid 30.06 sign, only some credit unions.

Amusement parks are not off limits UNLESS properly posted with 30.06.

(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06
Subsection (b)(5) is the amusement park listed in PC 46.035. (i) is down the page making churches, hospitals and amusement parks to now have to post or follow 30.06, otherwise it is legal for CHL to carry there.

Amusement parks must be 30.06 posted to be off limits. They are not automatically statutorily off limits any more.
Sec. 46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE HOLDER. (a) A license holder commits an offense if the license holder carries a handgun on or about the license holder's person under the authority of Subchapter H, Chapter 411, Government Code, and intentionally fails to conceal the handgun.
(b) A license holder commits an offense if the license holder intentionally, knowingly, or recklessly carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, regardless of whether the handgun is concealed, on or about the license holder's person:

...

(5) in an amusement park; or

...

Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06.

By "location" I meant Galveston in general, not the specific location of the park. I wouldn't go anywhere in Galveston unarmed.

I went on Saturday with my 2 kids and a friend and her son. We all had a great time. Although we did run into one interesting fellow who was having a pretty violent disagreement with himself / the invisible guy next to him. That was about 1/2 mile away when we stopped at a Subway on the way home. He didn't interact with us, so no issues other than me switching to condition red for a few seconds.

I couldn't find any 30.06 signs on my last visit to Galveston. I think I saw one 51% sign.

Is your sole concern with Galveston running it down in every thread?

Eight things you'll never hear in Alvin:

8. Mom! Dad! I got a scholarship to Harvard!

7. I'd rather go to the opera than the ballet tonight.

6. I'd rather go to the ballet than the opera tonight.

5. I'd like a double latte.

4. I'll have a Perrier. I'm the designated driver.

3. She's too young to be wearing a bikini.

2. Honey, we don't need another pit bull.

1. You can't fix that with duct tape.
