That depends. The two Justices who are thought to be retiring during the next four years are Ginsberg and, possibly, Breyer. Both of them were appointed by Clinton.psijac wrote:By the time this gets to the supreme court Obama will have had packed it with all progressives
Ginsberg consistently votes liberal; in fact, she almost always dissents with any ruling of the Conservatives on the Court. She is the most liberal member of the court.
Breyer usually votes liberal, but has voted centrist in the past.
Both Breyer and Ginsberg voted against the Heller decision. Breyer wrote the dissenting opinion.
If both of these Justices retire, and Obama is re-elected, he will replace them with people just as liberal, thus maintaining the status quo on the Court. If a Republican gets elected, then I have no idea who would replace them. It would depend on who the Republican nominee is. I could see Romney putting a moderate in there who might turn out to be liberal, much as Souter was who was nominated by G.H.W. Bush. Kennedy, who was appointed by Reagan, also sometimes votes liberal.
If the GOP gains control of the Senate, however, then the GOP could filibuster any nominee which they believe to be too liberal.

Thank you for your concise explanation.codeguy wrote:The typical pattern of appeals would be this, assuming that whomever loses at each stop along the way wants to carry on the fight:RHenriksen wrote:Yep, this looks like a BIG lever. How many hops to get to SCOTUS, assuming MD appeals?

Federal judges are appointed, not elected...drjoker wrote:come election time, I'm going to write a check to judge U.S. District Judge Benson Everett Legg's re-election campaign!

And pray it isn't one who primarily appoints anti-gun/anti-freedom "loophole-closing" (freedom-taking) type Judges .... but has a record of >>> "says-anything-to-get-elected"RoyGBiv wrote:Federal judges are appointed, not elected...drjoker wrote:come election time, I'm going to write a check to judge U.S. District Judge Benson Everett Legg's re-election campaign!

“Many of Romney’s appointments were not only liberal, not only Democrats, but were radical counter-constitutionalists. How on earth can we expect that, as president, he would be any different?” Barber asked rhetorically.

This is a great thing. When I visit my parents in Pennsylvania, I drive thru Maryland and West Virginia. I am so nervous in that short streach of I-81. They are so anti gun there.
What I am waiting for is West Virginia to allow Texas CHL holders in their state so I could just carry away! Or Ohio for that matter!

Another victory! It's good to know that there are a few Judges out there who have read the constitution, and not just used it as a coaster for their coffee mugs!

We, too, have relatives in PA. When we drive through MD, I lock the gun and ammo up to meet the Federal transport requirement. The last thing that I'm worried about is a MD LEO but then I make sure that I'm not over the speed limit, regardless of how fast those around us are going. It helps that we are in an RV.magillapd wrote:This is a great thing. When I visit my parents in Pennsylvania, I drive thru Maryland and West Virginia. I am so nervous in that short streach of I-81. For WVA, you could get either an AZ or a Utah out of State license and solve the problem. Utah solves Ohio, too. I'm probably going to do one of those myself this year.

Have the same situation. Looks like there is no easy way to get to PA without locking it up in the trunk. My family is planning a PA trip to visit relatives this summer, and I too am worried about that little bit of MD you have to go thru on I81.chasfm11 wrote:We, too, have relatives in PA. Re: MD gun law found unconstitutional
This is great news. Hopefully (although it will take time) it will make a difference.
When I lived in MD I frequently carried large sums of cash while making deposit for a retail store. One of my Assistant Manager's was stabbed dropping of the nightly deposit. I took this info to the local State Police barracks and asked for the application for a CCP. They wouldn't even give me the paperwork!

Actually, AZ solves Ohio as well. AZ gets you NV, OH, WV. It cost $60 and you can use your TX CHL as proof of proficiency.chasfm11 wrote:For WVA, you could get either an AZ or a Utah out of State license and solve the problem. Utah solves Ohio, too.
