2 PI in 1 yr.
I was arrested twice in the same year 8 years ago for PI. Long story and happy to share if anyone wants to hear more but I was not out causing trouble. Blew .09 on both.
Q#1 will that disqualify me from getting my CHL? I am taking my class on Saturday.
Q#2 I didn't list this on my online app because at the time I filled out my app, I didn't think it was a big deal because my lawyer said they are just like traffic tickets so no worries. I have had many background checked for work, volleenteer work for school and purchasing guns and nothing have ever shown up. I found this site after the fact and now I see that was the wrong thing to do. How can I can my online app?
Thank you for the help.

"An individual who has been convicted two times within the 10-year period preceding the date on which the person applies for a license of an offense of the grade of Class B misdemeanor or greater that involves the use of alcohol or a controlled substance as a statutory element of the offense is a chemically dependent person for purposes of this section and is not qualified to receive a license under this subchapter. This subsection does not preclude the disqualification of an individual for being a chemically dependent person if other evidence exists to show that the person is a chemically dependent person."

Good thing Public Intoxication is a Class C misdemeanor. You should have listed them though if you were arrested. Better get to fixing that ASAP.apostate wrote:"An individual who has been convicted two times within the 10-year period preceding the date on which the person applies for a license of an offense of the grade of Class B misdemeanor or greater that involves the use of alcohol or a controlled substance as a statutory element of the offense is a chemically dependent person for purposes of this section and is not qualified to receive a license under this subchapter. That's the part I'd worry about if I were you. I'm sure some of the wiser gents will chime in.apostate wrote:True, and... Seriously doubt that would come into play considering how long ago the charges were filed on the OP and the fact that he hasn't had any brushes with the law, at least dealing with alcohol since.apostate wrote:True, and... No need to overthink things or worry about the big bad government boogie man coming to block you but getting those arrests listed will be a big deal if you don't take care of it. I'd call the CHL office and try to intercept the paperwork. I seriously doubt that anyone at the CHL office is going to even care that you got busted twice in a calendar year for PI. If they ask just tell them you were a college student. 'Nuff said.

Thanks all. I did contact the CHL office to add on my app. Wife and I are going to class tomorrow. I hope to be part of the team soon.

Oh yes they were both silly situations in the first place. Passed written with 100 shoot on Monday. Thanks! BTW, the place I went to today thinks very highly of this board and the people running it.

Fire your lawyer. PI is nowhere in the traffic code.

I think what he was trying to say was that his lawyer compared them to traffic tickets because they are both a class C misd.gigag04 wrote:Fire your lawyer. PI is nowhere in the traffic code.

When I was getting my clearance in the Army, I was asked by the NSA interviewer some, shall we say, uncomfortable questions. Noting my hesitancy, he turned off the recorder and leaned in saying, "If there is no record, it didn't happen." 'Nuff said.

Re: 2 PI in 1 yr.
PI is not merely being drunk in public. The law says they're also a danger to themself or others. Most people I know don't have any PI arrests, much less convictions, so two would raise a lot of questions if I was doing a background check on someone. Even for a desk job.

The law you quoted says differently.
P.S. THAT IS NOT A PERSONAL ATTACK
Tyranny is identified by what is legal for government employees but illegal for the citizenry.
