I would worry about the clerks actions of trying to close up the store being interpreted in a court setting as provocation. I can just here an attorney describe about how one of the shoplifters was in fear of their life when the doors were pulled closed.

It would be a different matter if the gang had simply grabbed the clerk without any action that could be considered provocation.
Good point. :cheers2:

OP is correct -- and did not make a racist statement.
Nobody said that the OP said anything racist. Noting we are saying is racist. Just truthful.

If you watch the video it is very clear that the mob was black and the clerk was white.

We are simply wondering why the black community has not spoken out against these "Flash Mobs". I have yet to see a white violent "Flash Mob". And stated that had the clerk defended himself or the roles been reversed the black community would be crying foul.

Their silence on this speaks volumes.
And so would any other community. If the roles were reversed, I can guarantee you it would be no different with the community. So, no more talk of race in the posts or it will be locked.

How is that provocation? He was in charge of the store at that moment and was trying to stop the thugs from stealing the store's property. He did not provoke them. They provoked him to take the measure he did to prevent theft/robbery.

You're a clerk at a convenience store that has probably prohibited you from having and using a weapon in your own defense, you're making minimum wage, and you're going to put your life at risk and potentially have to defend yourself by shooting someone --all to stop a bunch of people from stealing beer and donuts? You're going to put you life at risk, and risk going to jail, to defend a couple hundred dollars of property that the owners don't care enough about to defend themselves? That's crazy.

The people responsible for protecting the store's property are the people who own the store. They apparently don't even care enough about the clerk's life to spend any of their own money on security. They have obviously made the decision that it's cheaper to let people rob the place than it is to provide enough security to deter or prevent it. And that is essentially why these flash mob robberies continue: it's cheaper to let them happen than to prevent them. That means they're being written off as a cost of doing business and are not likely to stop.

Sorry I did not mean to make this a racist issue. The clerk could not have stopped this. Society can stop this.

Whatever the discussion about the root causes of this heinous event might be (and I ain't getting into that one), wouldn't this be considered a serious "disparity of force"? I've said several times on here that it would take a very situational event to get me to use my weapon in "defense of property". I agree that being a convenience store clerk for some place that really didn't seem to care much about security wouldn't warrant trying to protect that place's merchandise at the cost of your life. However, IF the mob had decided to turn on the guy "just for the fun of it" since they were so wound up already, I simply don't see how anyone of a SANE MIND in THIS state following OUR LAWS could say anything but "self-defense". I don't mind working hard to make a living, but some jobs just aren't worth it. And you know what, it probably IS just matter of time until one of these situations does turn deadly. I hope and pray, WHEN IT DOES, that the bad guys are the only ones who lose out on that deal, but I worry it won't be that way. Every day I feel just a little more dejected and sicker about how things are going in this country...and it ain't just some of these politicians that are to blame, but also the ones who put them in those offices.
