Curiosity killed the cat and gun fondling has done the same for many would be criminals, children, and Darwin award recipients. I don't understand the sense of entitlement to mess with that which is not your own. My children demonstrate more restraint and maturity. I understand the original post may not have depicted the situation correctly but to see the responses that condone the behavior as it was originally posted is shocking. I hate to be reminded that my utopian view of CHL holders being model citizens is foolish. How is disarming a CHL holder and dry firing a $3k weapon without permission acceptable? In my book that was an abuse of authority by the officer and lack of morals, values, and respect on the part of the rider. If acting upon your curiosity and touching what does not belong to you is the new accepted behavior, call me old and remind me not to leave my wife alone with you. Flame away......

At your request........... First of all, the rider in question was recently engaged in several years of combat operations in the spec ops community defending your right to insult his integrity. How's that for starters? Secondly, yes, it was indiscrete to play with the other guy's gun, but it wasn't a HUGE offense, and while you point out your surprise at some of the other responses, I am surprised that you feel comfortable insulting people you don't know on a public forum.

TAM....I have another wish. Read my post again. I acknowleged the subsequent post that clarified that the original post was not clear as to how this transpired. My intent was not and never has been to insult someone on this forum. That is not what this forum or it's members are about. I thought my response was clear that my opinion was related to the situation originally described and not aimed at the poster. This was an opinion of the responses. Here's another opinion....while I appreciate anyone's service to our country, that does not mean the individual is immune to character flaw. And no that is not directed to you or any member of the forum. Just pointing out that I do not agree with your assertion that service is equal to saint hood. If I understood the intent of your post correctly.

Are there any legal issues in this scenario pertaining to a police officer on duty handing a citizen a temporarily confiscated or
an item of potential evidence ?

...prolly so, but in real life it happened...it cost noone anything...and we don't need mommy-lectures...it's a MINOR infraction by both the officer and the ride-along...but on a scale of 1-100 rates about .21...unless you're just waiting to jump down someone's throat and sling garbage around...in that case, as we see...it made some folks' day...

I agree 100% with Speedsix; it really wasn't a big deal. No one needs mommy-lectures, whether they face the badge or stand behind it. People (LEO's, citizens, EVERYONE) need to relax and little.

I'm not sure where I should begin, so I'll just ramble in my defense.

"Service does not equal Saint Hood?" Nice. I do appreciate TAM coming to my defense, but I dont think that is what he was trying to get across. I never claimed to be a saint, and It would be foolish for anyone else to think so. However, I have extensive experience with handguns, long guns, explosives--whatever. I know my way around a handgun, and the chances me being the "unfortunate curious cat" are about as slim as can be. Since we are apparently in the business of burning eachother in this forum, I can assure you I am perfectly capable of taking your handgun from you, unloading it, examine it thoroughly, and then assisting you with inserting your foot in your mouth without a single ND\AD. Then again, sometimes bad things happen I suppose.

Your children exhibit more maturity and responsibility? I have no doubt you have raised them well, but if you are implying that I am irresponsible and immature--Your wrong, sir. Assuming I am any of the above for "fondling" a handgun that was given to me to look at during a routine traffic stop is a little premature, wouldn't you think. I ask that you keep an open mind, assume that you (or most of the people on this forum) would have done the same exact thing I did. Also keep in mind that I did nothing wrong, except for a few other individuals on here I think most would agree. If it was in any way criminal, please show me how. If it was your gun, and you informed me after the stop that you were unhappy about it I would appologize profusely, and we would probably carry on without a second thought. Maybe not, I guess you would come on here and blast me for it. I dunno.

Lastly, I dont want to hear any more bashing of the deputy I was riding with. He is definately beyond reproach, honest, and a model deputy sheriff. Fact is that he was perfectly within his rights as an LEO to confinsate the handgun temporarily, and as I have stated above, he did nothing wrong by handing it to me to admire while he ran the gentlemans plates\license.

So what it comes down to is whether some of you think it was right or wrong by your personal standards to handle this gun. Some of you think it was wrong. Some of you think it's ok. Some think it's unprofessional. The fact is that there was nothing illegal about it, and to bash and flame me is irresponsible/unprofessional/premature/etc.
