Of course that was after I showed him my approval paperwork from the bank. He was not happy.. He was trying everything to get me back in the building.. Told him I would, but since I am carrying, I don't want to break their rules. Bye...

It's always a dangerous thing to out oneself to a stranger, especially in the course of conflict. One could certainly make the argument that if you were arrested and and testimony were brought against you it would be a problem for you. So often all people hear when you're talking is, "Blah, blah, blah, blah, GUN!!"speedsix wrote:...you did it just right...don't let anyone talk you into living in the "what-if" fearful land of Oz...if the guy wants to file a false police report, and lie on the stand...that's HIS problem...you stood up and said your piece and stood up for all of us...thanks for doing so...then you took your money and left him with his mouth hanging open and his sales further down for the month...he may not change...but he won't forget!!!

OK, so what would be the charges? I guess our perjuring car salesman could say he waved the gun around, but presumably he could make that argument about anyone that came in the store and didn't buy a car, regardless of whether the person had a CHL or not.Embalmo wrote:It's always a dangerous thing to out oneself to a stranger, especially in the course of conflict. "Officer, he came in, argued with me, he was angry about our store policy, he said that he wouldn't come back, and oh yea, on the way out he told me he was carrying a gun." You have to ask yourself if you would want this TRUTH to be conveyed to a police officer, and a local television reporter.

Would verbally outing your CC to someone be considered intentional failure to conceal? If so, then there's the charge.ScottDLS wrote:OK, so what would be the charges?
No, it would not.RottenApple wrote:Would verbally outing your CC to someone be considered intentional failure to conceal? If so, then there's the charge.ScottDLS wrote:OK, so what would be the charges?
Note that the offense occurs when one "intentionally fails to conceal the handgun". It says nothing about intentionally failing to conceal the fact that you have a handgun.PC §46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE
HOLDER. (a) A license holder commits an offense if the license
holder carries a handgun on or about the license holder's person
under the authority of Subchapter H, Chapter 411, Government Code,
and intentionally fails to conceal the handgun.
My interpretation is that telling someone that you have a gun is NOT failure to conceal, because the gun's presence was not discerned by "ordinary observation" (at least no more so than I discerned Bin Laden's location because the news told me about it).RottenApple wrote:Would verbally outing your CC to someone be considered intentional failure to conceal? GC §411.171(3) wrote:"Concealed handgun" means a handgun, the presence of which is not openly discernible to the ordinary observation of a reasonable person.
