business improperly posting 30.06

I went in a pawn shop today to browse guns, and they had posted a sign saying no loaded firearm in store. I was carrying, but paid the sign no mind. (There was no posting of the penal code anywhere on the outside of the building.) I went in, and looked at their firearms. I didn't find anything of interest. As I was leaving, I say a sign behind the counter posting 30.06. Too late, I was done and leaving. I'm a fairly new chl holder, but I'm certain that that is not a proper posting?

Agreed. Has to be before you get in. What pawn shop and where?

Was it in Spanish too?

Were the letters 1 inch high?

It has to exactly meet or exceed ALL the requirements of 30.06.

It was definitely not posted in the proper location like pcgizzmo said.

It was a Cash America Pawn in Houston. I go in different ones all the time, but I have never seen the posting. Seems like an individual at that one location rigged it up, but doesn't know exactly what they are doing?

It was on a poster board. Hanging on a hook. Not in spanish.

Funny to me ... I was at a Cash America Pawn shop in Arlington on Friday and they had a similar 30.06 sign posted a the front door. About 12" wide in english, small script ... maybe it just scares off the real customer ... lol

Good point. That's presumably why the 1" requirements/contrasting background/English and Spanish. A proper 30.06 sign is pretty hard to miss...by design.

In the OP post it appears that sign clearly did not meet the requirements...even if it did, he did not "receive notice" until he noticed it on the way out. If he then complied, I believe he did not break the law. :rules:

PNCTR: I have probably been in 50 of their shops around Houston ( I'm a bargain shopper), and this is my first time to see any posting? It's good to hear someone else has seen some type of posting at another of their shops. I know that i won't shop at one that posts that sign right or wrong. :txflag:

The first saign saying "no loaded firearms" could be understandable and not aimed at CHL holders. People bring guns in to pawn regularly. You don't want somebody bringing a loaded gun in hand to pawn. Maybe I'm giving them too much credit, but I see that sign on most pawn shops and always assumed intention.

Not also in Spanish should not be enforceable. However, it does not have to posted at the entrance to be seen prior to entry. It only has to be "displayed in a conspicuous manner clearly visible to the public."

Penal Code Section 30.06(c)(3)(B) further states that a sign must meet the following requirements:

i. includes the language described by Paragraph (A) in both English and Spanish;
ii. appears in contrasting colors with block letters at least one inch in height; and
iii. is displayed in a conspicuous manner clearly visible to the public.

Funny, just today I saw a half-hearted attempt at a 30.06 sign on the Cash America Pawn on US 290 across the parking lot from Red's Indoor Range.

I'm not sure how high the letters are but it's pretty plain they don't want you in there. If you got caught, you would be takin a trip to the Sunset Valley PD.

Just go in there and let them know that you and your cohorts will not be spending a dime in that place.

Or just walk in there with an AR-15 on a shoulder holster. Sign doesn't say "no weapons" just prohibits licensed concealed handguns
