He's lucky he didn't injure an innocent. I wonder if he will get charged for illegal discharge?
This is a good story for learning and thinking about tactics. I can see a person becoming very angry if he sees someone running out of his house carrying something and firing out of shear anger and frustration. I would suggest that all gunowners think about it before it happens and make your decision then, not in the heat of passion.

In most cases, if you fire on a dude running from your house. Anything that he is holding will get dropped, and broken.. Loose loose.
