Tomball: Alleged teen burglars have a short career
In Tomball late Friday the owner of a machine shop confronted two 17-year-olds who were allegedly removing his property.
One teen is in the morgue. The other 17-year-old is in a hospital. A 15-year-old is in custody. One of the alleged burglars was allegedly armed. However, it looks like a classic theft in the night time situation.

Harris County grand juries tend to side with legitimate defenders. Probably most of them have been victims of theft, burglary, or worse crimes.Beiruty wrote:no bill, should be as recommended by the DA.

Unless he has a juvenile record (probable) the one in the hospital is legally an adult for prosecution purposes.
If he is still considered a juvenile, it is likely they will petition to try him as an adult.
The 15 y/o is quite likely to be tried as a juvenile, IF he didn't commit any violence.

ABC's coverage on this was pretty good. Check out the video:
Homeboy ain't in heaven, that's for sure.http://abclocal.go.com/ktrk/story?secti ... id=8009442
"Why couldn't you just tell 'em stop, shoot 'em in the leg or something?" Warn 'em, so he could still have his life. Now homeboy is dead in heaven," Silva's friend, Chase Gomez, said.
Carrying since 02/06/2009.

Comment shows a lack of knowledge, but 50 years ago I'd have thunk "shoot 'em in the leg" too. And of course moving legs are increased chances for a miss and innocents far away to be injured because bullets which miss don't just evaporate. Also, Pasadena Officer I knew who rarely, if ever, wore a vest, feared getting shot in the leg more than anything, he knew about that artery down yonder.sss wrote:ABC's coverage on this was pretty good. Is burglary a mortal sin? That decision is above my pay grade.sss wrote:Homeboy ain't in heaven, that's for sure.
These comments by friends and relatives are as predictable as flies at a picnic. Really, does anyone expect them so say, "The little dirtbag deserved it"?

"The teens are facing charges of burglary of a building, officials said."
Does the "felony murder rule" for prosecution no longer apply in Texas?

The prosecutors need a charge to set bail. They can add charges later.
Also, as serious as this case is, they tend not to come down so hard on a first-offense felony by a 17-year-old.
