They guy in the booth must have ordered the "Lumberjack Slam" with extra/repeated slam.

I wouldn't have to react to a situation like that, as it would have deescalted it way before it happened. Sometimes a simply "Hey, sorry we offended you, but we can move or you can move, I am just trying to get something to eat and get home sleep" goes a long way. Discretion truly is the better part valor.

As a side note, it was nice of the girl in the booth to hold her boyfriend's head in one position so the attacker didn't have to work so hard to connect.

It is not the bus boy's job per se, but the manager is responsible for the safety of his guests IMO. There are only a tiny fraction of circumstances (I have never encountered one myself) which cannot be contained by an attentive manager. If you see a potential problem brewing, but sit back and hope that things cool down on their own, a few ugly words can grow into a brawl. There is more to managing a restaurant than ordering the napkins. This event represented a major failure by the manager on duty.

What amazed me is how the rest of the customers just sat there ... Had I been a patron, I'd have been on with 911 immediately as I headed for the door as altercations like this can lead to shots being fired. I don't want to get hit (by fists or gunfire) in the melee. Best to get some distance between myself and the actors.

The local police have said they've identified all people in the video. However, nobody is getting charged because in their local jurisdiction someone can only be charged with simple assault and battery if the act is committed while in the presence of a police officer. That doesn't really make sense to me.

I avoid these types of places at night for this very reason. Much nicer to eat pancakes at home!

And that video is not admissible in court of law? So, one wife beater can beat his wife and Police do nothing cause, cause the Police did not witness the beating. Nice, I like it. Both the lady and he big Bully boy should be arrested and thrown in jail.

Oh, how many witnesses where in that restaurant?

If I'm a patron: I would not even pull my gun out as this "fist fight" didn't get to the point where imminent serious bodily injury or death was a concern. To me it was just an argument that boiled over to simple assault. Besides WAY too many people around to justify pulling out a firearm.

Sorry to burst your bubble Old Gringo but Texas has the same kind of an approach. Our daughter's car window was smashed, her dash was ripped open and her Alpine stereo was stolen. They caught the guy who pawned it in Irving (it still had the CD that she could identify inside of it) - along with 69 other stereos which had similarly been ripped from the dashes of Hurst-Euless-Bedford cars over a three week period. The DA refused to prosecute (even though this guy already had a long rap sheet for similar thefts) because no LEO observed him committing the actual thefts.

Crimes only happen if LEOs see them. :banghead:

Where is the line of demarcation for LEO's to have to witness a crime? I'm sure they don't have to witness a murder to prosecute it.

Not true. Domestic violence. Many others. Quite likely what you have is a DA who is way behind on cases and doesn't want to add to his/her burden. The voters should lighten his/her workload. ;-)

ETA: It would seem the video is connected with the TV series "The Smoking Gun", so I would be very skeptical that this incident really happened. That particular producer is well-known for "staging" things for the TV show.
