Forest Hill drama- one is CHL holder

#1

Post by magillapd »

here is the story http://www.star-telegram.com/2010/12/22 ... -have.html

I posted this here, not so much for the base of the story, but rather that the story makes mention of the councilman's CHL status.

Points: Would a citizen be affored the choice to simply go and put the gun in his/her car without being arrested?
CHL is supposed to be confidential, now everyone knows that this councilman has a CHL.

Big mouth, or mayor can ask his buddies to look it up. In any case, the councilman when asked if he was carrying retreated to his car and disarmed. As CHLer, he should know better not to carry at city meetings.

Now the question if an LEO asked if you are carrying and you were in a place not supposed to carry, you did not answer or lied, can he search you with no warrant? Also assume you comitted no other offense. Same as the what could have happend here, asked are you carrying, you ignore the question and you go to your car and drive or disarm.

The councilman stated that there were no signs prohibiting carry at the meeting. The newspaper article is wrong. CHL carry is only prohibited if the government meeting is posted 30.06. I've heard that the State Legislature is considering NOT posting this session.

As an interesting (hypothetical side note) - even if the meeting had been posted, if he was a member of the city council, coudln't he write himself a note saying he had permission? As a city council member I would sure think you would be in control of the premises (if not, who is!?)

Sir I percieve you live in one of the high population MetroPlexes. I am one of those Morons that you speek of. It is possible in the big city to do as you say.
In the rural areas & very small communities it is almost impossible.
I am an instructor. But for 10yrs or so before I began teaching I trained new shooters & prepaired them for the proficiency portion of the test & in doing that often went to the class w/ them. Since CHL started in '96 no doubt in my mind that I have been to no less than a dozen classes.
I have never walked in one that no one knew me.
Someone would holler across the room, "hey preacher, whatchu doin here?" "Same thing you are."
I am on 1st name basis w/ Chief/Police, most of the councelmen, city attourny ( :cryin he really dont like me :cryin)
At any given City council Meeting in Diboll, PD Chief, myself & a dozen or so citizens can look around & name SEVERAL that are most probably armed. Many of them know my signature line. We dont advertise it. Just kinda hard to hide it.
Population of my county is probably not as much as your precinct.
That someone knew the small town councilman had a CHL & was probably armed is not at all psyco, moronic, careless, stupid, bragging, .....

I am not a lawyer but I would think that would be the mayor or the City Attourney enforced by COP.

Even then, I don't think even they could give someone permission to ignore a 30.06. Isn't LE or a judge the only one's who can give someone permission to do that?
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

Not 100% sure, but I don't believe a LEO or Judge can give you permission to pass a 30.06, but the person who posted it can. In this case, the Mayor, City Attorney or other person who was responsible for the decision to post it for the meetings would be the authority who could give you permission to ignore it. There was a discussion on this on the forum awhile back on this, but my search skills are lacking this morning. Will see if I can find the thread.

Sounds more like Chicago politics to me.

Or any other machine politics, which is why NY State is still saddled with "Big" Tim Sullivan's legacy. http://en.wikipedia.org/wiki/Timothy_Sullivan" onclick="window.open(this.href);return false;

I drive through Forest Hill on way to work and live only about 8 minutes south of there. It's not an area to be unarmed in. A small town with big city crime...and way too much drama in politics. :boxing
