San Marcos: Home invasion stopped

In San Marcos early this morning a resident fatally shot a would-be burglar. Police said the defender would not be charged.

This incident could be related to an attack on an 18-year-old female at the same home Saturday.

Grand jury declined to indict the homeowner earlier this month.

According to the homeowner, the now-deceased 19-year-old man had already broken into the home once and was trying to break in again when the homeowner shot the intruder.

The deceased man has been described as mentally retarded.

The mother of the deceased man is considering a civil lawsuit. This might be a first since civil immunity was passed.
