Apparently he fired at the victim while he was in a vehicle claiming he thought the victim was going to run him over. The investigation, however, revealed that he was shot from behind.

He was working for security firm - that probably means he was not carrying under CHL - correct?

I think that's correct under private security rules in Texas. Even if someone has a CHL, that alone does not authorize them to carry a handgun while working security.
