"Kagan believed that the President could circumvent the role of Congress and to act unilaterally, without any legal authority, to impose restrictions upon the private ownership of handguns."

We already have a president that thinks he's above everything. Substitute "Private Ownership of Handguns" with "deepwater drilling" - his lackies keep pushing accross a drilling ban even though the courts have already ruled against it. :mad5

I'm not a Kagan fan but why do we think the next nominee will be better for us? Obama has at least two more years so the next justice will be someone he nominates. So being realistic, what's so bad about Kagan that we're willing to trade her for what's behind door number two?

Because not every liberal is anti RKBA. You defeat Kagan because she is "blatantly" anti RKBA, with strong evidence to show that. Perhaps the next will be less so. I don't see one coming along any worse - yet.

Both of the Texas Senators said they will vote against Kagan but it looks like she will get confirmed anyway, despite no experience as a judge. Not even traffic court.

So what can we do? The Senate vote looks like it will be along partisan lines. Should we vote against anyone who puts a (D) next to their name in November?

Although I'm not a big fan of the Republican Party as it stands today, it beats the heck out of voting for a Socialist.

Listening to the radio yesterday, the comment was, a couple of Dem's were NOT voting for Kagan and
a few Rep's were going to vote FOR her. Anyone have a list of these names?
