03Lightningrocks wrote:Again... I am not a lawyer and no expert on being arrested. I am just saying that this is how it worked in my case. Apparently it is how it is going to work in the OP's case also. What I learned from my case is that any time you use a gun for self defense, no matter how obvious it might be that you are justified, be prepared to get arrested and go to jail. The cops will tell you right quick that it is the judge and juries job to decide if your right or wrong.

Thinking about what happened to the OP, I have about come to the conclusion that the cops received a call about a guy with a gun. They responded in force. once they had put on such a huge show, they believed they had no choice but to arrest the OP until they could sort through the details of what happened. I don't think I have ever heard any stories about cops changing their mind once they decide your going to be arrested. Looking at it from their side, what if they had turned him loose and he went down the road and shot someone? Until they can figure out just exactly what is what, they have to take the safe way out. At the point of his arrest, they probably didn't know the details of why he had the gun and why anyone saw it. All they had was a report from a security guard stating that some guy was in the government building with a gun. I am not saying what they did was necessarily right, but neither was arresting me when I was defending myself. Hey, what you gonna do... the cops have to be sure they don't turn a feller loose that needs to be in jail. I have heard about others in self defense situations going to jail initially. Be prepared fellers. Your carrying a gun... cops take guns seriously.
I'm not disagreeing with you here that to the LEOs Gun = jail. They had their mind made up. Why should they spend a few minutes questioning me and the one who called it in? They don't have to spend any time in jail right. How about was he threatening anyone? Was the gun ever out of its holster? If I were going to murder someone why would I get a CHL.? Just sayin a little common sense would go a long way here.

Well, I’ve decided to carry something a little smaller. Perhaps a Kahr PM9.Glock 26. Any suggestions? I think that a new gun will really cheer me up and help me forget about this incident. :cheers2:

I will say the Kahr PM's and CW's conceal extremely well in a Galco USA IWB holster. They are tuckable and very comfortable. I carry either my CW40 or the PM9 I bought for the wife at 4:00 or 10:00 in that holster no bulge visible.

I'm glad there were no long term repercussions for you.

I like my G26. I can carry full size G17 mags for spares. Best of all, I know I can hit my target with it. I tried out a bunch of pocket guns but I found them inaccurate except at very close range.

I carry anytime I leave the house. I'm using a Mitch Rosen tuckable IWB. Very low profile on the belt.

Carry On.

Thanks, I know the question of which gun to carry has probably been brought up here before. :deadhorse: And I know personal preference plays a role as well. I'll just have to take a trip to the gun store and see what feels right.

I truly hope you don't think I was implying that you needed arresting. Not in any way, form or fashion do I think this. I was just stating the fact that once LEO decides you are going to jail, they don't change their minds. I was also just trying to give a perspective from the panic stricken law enforcement community. I think they are all on guard for a wild shooter these days. We have had a few recently and it doesn't take much to set them all off. From LEO's perspective, you were exposing your weapon in a government building. A CHL doesn't allow for this and if someone says they saw our weapon, it could mean trouble for any of us initially. The theory being, if you were carrying concealed, nobody would have seen it. Arrest now... figure it all out later is the philosophy when it comes to guns, bombs , drugs or murder.

Anyway... see my post earlier about how I recommend carrying and why. The PM9 or PM40 are excellent choices. Both are short barreled guns that don't want to protrude up like the flag at Poncho's every time you sit down. :tiphat:

My daughter has the G26 and I have the G27... both good choices but a tad thicker than the PM series. Think short barrel. ;-)

Lightningrocks, the common sense remark was aimed at the PD not you. Your posts have been well received. Reducing the barrel by 1/2 inch may not sound like much but in my case may make a huge difference. I appreciate your advice. :tiphat: As you said, if this were to happen again within two years the judge may see it as reckless rather than accidental.

The TSRA did respond to my e mail and my case is being evaluated, The NRA has not responded. I would like to bring awareness to this overreaction of the PD on behalf of all CHL holders. This is not about personal gain or having them pay my legal bills. I believe Williamson County has more CHL Permits holders than any other county in TX. There are a lot of us out there and I think it’s time to update the policies. An open carry law is a good idea. Most of us would still keep our guns concealed but would not have to worry about the gotcha mentality of some out there. :patriot:

I don't know what you define as close range. I know Glocks are fine weapons, though I carry a Kahr PM40. I can put both my mags inside a six inch group at 10 yards and am never out of the outer ring at 15 yards. I am beating handogs dead horse I know, but I am impressed with the Kahr's accuracy with only a 3 inch barrel. A pistol's ability to lock up the same each time is more important I think than barrel length. I have a full size Smith plastic 9mm that shoots all over the place and is worthless unless I wanted to bash some one over the head. I carry at about 3:30 and sometimes even carry in my windbreaker or jacket pocket. Nothing against Glock. I have shot a few larger Glocks and a KelTec .40. Graet guns. It's whatever you can be confident with. I carry a Model 60 Smith sometimes and it's a good little piece but shooting it double action is nowhere near as accurate than the Kahr. The guy who used to run Marksman Range in So. Houston in the 60's could drill the black at 50ft with a Model 37 Smith (Airweight) one-handed shooting off hand. Good eyes, steady hand! I always told him I would never want to be in his sights at any range. Having had a pistol in my face twice in my lifetime (Prior to CHL law) I can tell you your encounters will most likely be well within 10 yards so anything that hits the same area twice will work and a Kahr or a Glock will fit the bill. Good shopping handog. Hope you feel better real soon!

to answer the question that was asked, yes, you have the right to a speedy trial, and that right starts as soon as you are indicted. You usually have to be indicted within 3 days or so of being arrested, or let go.

After reading that Watauga story I am left wondering if these departments that act hostile aren't suffering from an ego problem. It seems as though they are trying anything they can to keep from admitting they did something wrong.

I know at the beginning of this thread some of the brothers in LE were saying we shouldn't sue for this kind of wreckless law enforcement, but how else is it going to be stopped. They aren't going to care about our silly little complaints. They need to be stung real hard, then they will realize the error of their ways. Maybe if some court cases where to be won in these issues, department heads would better educate their rank and file. They won't care as long as the only risk is a citizen complaint. They have to be spanked...just like a child.

I'm wondering why these officer that wrongfully arrested these people are not being held to the same legal rules that civilians are held to...

I also agree with the ego issue. Seems they're going above and beyond to maintain they were justified.

It just chaps my hide that these gestapo tactics go unpunished.
