It's over. Here is what I have learned:
1. Keep concealed hand gun at 3 o'clock, not 4 o'clock.
2. Don't assume that the police will stand down after a perceived threat is over and you show them your CHL.
3. Don't assume the LEOs know CHL law.
4. Have a pre screened attorneys phone number on the fridge'.
5. Don't assume the NRA or the TSRA will be interested in your civil rights case or return your call.
6. Buy two similar hand guns. You will have one when they confiscate the other.

Have you learned anymore as to when/if this whole thing gets removed from your record?

3 o'clock just doesn't work for me, looks like I have a growth. 4 o'clock has always worked well - could be body type.

These guys either got really bad intel or they need to find a new career field.

I have been amazed at the number of LEO's that simply don't have a clue about current CHL laws.

That just jumped near the top of my todo list.

This is the one that surprises me the most. Would be something great to bring up in Mesquite tomorrow.

I have several guns that I carry depending on what I am wearing so that would not be a big deal.

Tell me about it...To be honest, I have not heard of either organization stepping up to the plate in these instances. For one, I tried contacting the NRA several times to see if they share their finances (most organizations do) and heard zero response. If they can't tell me where my donations go, they won't get any more from me. Nor will I renew my membership and the memberships of the rest of my family.handog wrote:

I can't speak for the TSRA because I was told to make a written request for the information and then they will decide whether or not to share it. I have yet to write up the request...

This incident is a long time coming...Of course as much as I get around this forum, this is the first time I have heard of it...

There is a two year waiting period for a misdemeanor and ten years for a felony. In my case, after two years and $1000 I can have it expunged from record.
The PD returned my gun soon after the charges were dropped.
After spending a day in jail I feel more comfortable with my gun at 3oclock. At 4oclock I feel like it is exposed even though it isn't.
I was concerned before the incident, now I'm a bit paranoid.

I am hopeful one of the organizations fighting for our 2nd Amendment rights will pick up the banner on this. When a bump, line, crease or fold can precipitate the misguided (illegal?) actions and treatment that handog was subjected to something needs to change. Even if one can forgive the RRPD for their actions we are all but a phone call away from being in the same position as handog. Hopefully most PD's will have a more rational approach if one us is "outed" by some over zealous person. Once a CHL is produced the incident should have been and should be over for case such as this. Open Carry is the best solution, but mandatory training for PD's on CHL law would be quicker. I still am not understanding why a simple arrest would require two years to purge when there was no violation and charges are dropped. Does that mean I can be arrested and if someone calls the police and reports I shot up drugs in their presence and I am a diabetic taking an insulin injection. If I produced my prescription, and card and blood test is negative do I have a record that doesn't go away without attorney fees and a two year wait? That is outragous! Are they going to re-charge me later and decide to take me to trial? I won't know for sure until I get the 911 and police record. Although I wear over sized t shirts they naturally are pulled up when I sit down. As I said, there was a rent a cop behind a one way mirror behind me. I was sitting in a fold out chair. I'm not sure if it was printing or that it was actually exposed for a moment. I carry at 3 and the reason the gun doesn't stab me in the side or protrude higher when I sit is a combination of things. I never carry a long barrel pistol. By long I mean any gun with a barrel length more than 3 inches. My carry pistols are a PM 9, a Kimber Ultra, a Glock 27. Which one depends on how I am dressing. the pm 9 is the smallest so obviously hides better in more form fitting attire. It is pointless to carry a 4 inch or longer barrel gun when a shoot out is likely to happen at under 10 feet anyway. 15-20 feet and I will run like hell from my attacker, seeking cover while zigging and zagging. I don't need to be a gold medalist silhouette shooter to win a gun fight. I also carry low. By this I mean I adjust my holster to where the grip is just barely above my belt line. Not the whole grip...just the top half of it. I can grab it just as quick as a guy with his full grip above his belt line. Less grip standing above your belt line means less chance your shirt will snag on it and leave you exposed. I usually wear jeans and t-shirts when casual and wear slacks and button up dress shirts when trying to appear professional. I also will wear polo style shirts and when I do usually like them tucked. These styles all work great when the style of carry is as I described above. If I had a desire to carry longer barrel guns... 4" or more.... I would go the vest or Hawaiian shirt route some of the fellers on this forum have talked about. I am not a shirt over a shirt kind of guy.
Of coarse build affects how we all carry. I am a stocky guy... 5'10" 246 pounds. I lift weights three days a week and run 6 miles on an elliptical runner two days... so it isn't all fat... just a lot of it...LOL. YMMV.... build affects how we have to carry for proper concealment. Each one of us has to figure it out for ourselves. The one thing I can say applies to anyone is that a grip sticking up full above the belt is going to catch your shirt and expose you at some point. Even if it doesn't show the actual grip...it will hug the grip and form a good enough outline that a security guard trying to earn brownie points will see it and get you thrown in jail.
One more thing. A gun carried at 4 may feel more comfortable, when you sit down it is far more likely to stick out away from your body. Keeping the weapon snug against your body is the trick to proper concealment. Again... IMHO... WWFM.

As many of you may suspect, I ain't one to knowingly tempt fate or some dimbulb LEO or Judge's interpretation of the law. What am I missing here - what record has to be expunged if the gun was returned and the charges were dropped?handog wrote:

The record of arrest. Even if the DA chooses not to prosecute, the record of your arrest will remain. If they choose to prosecute the case at a later date they can.
