I keep hearing about all of this courtroom fear. How many cases are there where a chl has been raked over the coals in a court room for something like what we are discussing here. The law is very clear that if you have not been given notice under 30.06 you have not committed a violation. In this case he never saw or passed a 30.06 sign nor was or has he yet been given verbal notification as described by 30.06. Until he actually has committed an offense he has nothing to fear but fear itself. How about some links to those court cases.

I'm not scared. I'll fight it. The law is quite clear on what constitutes effective notice. You can not be sucessfully prosecuted for something that is not a crime.

Did you guys even read the section of the statute that Dragonfighter quoted? Is there anyone on this board who is the "owner of the property or someone with apparent authority to act for the owner?" I didn't think so.

Signs can be posted and signs can also be removed.

People can be misinformed. The OP could have been mistaken about which mall it was.

There is, beleive it or not, incorrect information on the internet.

Bottom line is that notice has to be given to me personally for it to affect me. Hearsay is just that. Hearsay. I don't know a blessed thing about any 30.06 sign at the mall in question. All I know is that some guy on the internet said there is one. I don't know the guy. I've never met him. I have no way of knowing if he is telling the truth.

Write Retailers at the Mall !

Hi,

Write to major retailers at the mall such as JC Penney to have them pressure mall management as they do not want to lose business:

Please keep the letters short and to the point. For example, this is what I will write;

Dear Mr. Ullman, I respectfully request that you pressure Mr. Coppola of Macerich to remove all 30.06 signs in front of the malls that they manage with a JC Penney's in it, especially my local mall, The Valley View Mall. My family will not be doing any shopping at establishments that do show support for our constitutional rights and therefore will not shop at Valley View Mall if the signs are not removed promptly. After you replace those 30.06 signs with signs that say, "The UNLICENSED carrying of a handgun on these premises is illegal," then we will resume shopping at JC Penney. 2% of Texans are concealed handgun permit holders but we have families and friends. Therefore, our present boycott is costing JC Penney a 8 to 10% decrease to JC Penney's profits. Concealed handgun license holders are retired police officers, judges, and other law abiding citizens who have passed an extensive background check. I invite you to support your company's profitability by supporting our constitutional basic human right to self-defense. Thank you, (my name).

Again, just keep it short and sweet. Just politely tell him that you've shopped there in the past, but will refuse to do so this Christmas if they don't remove the 30.06 signs to show support for constitutional rights.

You might be surprised to find that if we were to write letters to different malls, then our efforts would be too scattered to do any good. If you live in Texas, please call Valley View Mall and write JC Penney so that we'll concentrate our letters in one place for maximum effect.

P.S. I chose the mall as our rallying point because it is the most effect for the least amount of letters/phone calls (& work) since liberating the mall would essentially liberate over 100 businesses with just 1 letter written and one telephone call per person (one letter to JC Penney and one phone call to Valley View Mall).

P.P.S. The mall management may not take seriously our letters, BUT they WILL take seriously letters from major retailers like JC Penney. That's why we are writing JC Penney. JC Penney should be concerned about losing business.

This has been debated, but it's a long way from being established that a sign at some entrance other than the one you happen to use meets the definition of being conspicuous.
