New "Instructor's Pamphlet" on DPS website

#1

Post by VViper »

Just found a newly published copy of the "Texas Concealed Handgun Laws and Related Statutes" on the DPS website: http://www.txdps.state.tx.us/administra ... mphlet.pdf" onclick="window.open(this.href);return false;

It says "Instructors Pamphlet" on the front, and shows the changes in the laws with strikeouts and highlighted additions.

DPS advised in an email that printed pamphlets would not be available until probably the beginning of next year.

I haven't had a chance to study the whole document yet in great detail, but some of the changes in the online version show items that I don't recall seeing discussed before, such as GC 411.179 (c) regarding an instructor's CHL having his instructor status shown on the license.

GC 411.188 (j) is also also an interesting item. Does anyone esle understand this to mean that the classroom portion of the renewal class may be offered online, by either the DPS or by us?

Looking forward to going to the instructor renewal class to see what else might be in the offering.

Yes, but I don't see DPS doing it nor do I expect DPS to approve any instructor to do so. It is unclear whether the Internet class could be a canned video, or if approval would be for classes by video conferences so those in attendance could ask questions. If DPS ever approves any Internet classes, I suspect it would be the latter.

The way I read the changes to GC 411.179 Form of License and 411.181 Notice of Change of Address or Name, a qualified instructor (along with judges, etc) must now have the instructor status shown on his/her CHL.

The question is;
Do qualified instructors that held CHL's prior to Sept.1 need to apply for the duplicate license and pay the $25 fee so that the "qualified instructor" status can be added to the license or will the status update be added at renewal time?

If instructors do need to apply for the duplicate showing the status update, it needs to be done (as I read it) before the end of Sept. (within 30 days) since the law went into effect on Sept. 1.

I just emailed this queston to the DPS and will post when I get an answer. If anyone has already done that.....or if I've read the code wrong, or if you know the answer, please comment.

The way I read it, an instructor (or judge, etc.) is not required to have their special status on their license. However, if they do, and subsequently lose that special status, they would have to notify DPS and pay the fee to get a duplicate license without the gold star.
The information in this message is not provided in the course of a client relationship and is not intended as legal, accounting, or other professional advice.

I think as Insturctors` that have the old license , we dont have to change our license to the new one if we dont want to , but you could if you wanted and pay the change fee. I think thats the way it was said when I was in Austin , could be wrong though....

Second retraining session this year. Instructors will be able to renew after two years online with a tightly controlled test (to make sure it's really you taking it." Shooting requalification at DPS every four years. The license labeling instructors et all was also mentioned. It would appear on new licenses and renewals with no indication of immediate need to get a modified license.
