Carrying at church

#1

Post by MRR »

I have read in several posts about people carrying at church, but my booklet which is a 2007-2008 model has it listed as unlawful under PC 46.035. I was wondering if there has been changes made that aren't in my booklet.

IANAL, but church carry is okay unless posted 30.06. You have to read the law all the way to the end.

(h) It is a defense to prosecution under Subsection (a) that
the actor, at the time of the commission of the offense, displayed
the handgun under circumstances in which the actor would have been
justified in the use of deadly force under Chapter 9.
(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06.
(j) Subsections (a) and (b)(1) do not apply to a historical reenactment performed in compliance with the rules of the Texas Alcoholic Beverage Commission.

You need to read the complete section.

PC w6.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE
HOLDER. (a) A license holder commits an offense if the license
holder carries a handgun on or about the license holdets person
under the authority of Subchapter H, Chapter 411, Government Code,
and intentionally fails to conceal the handgun.
and intentionally fails to conceal the handgun.
(b) A license holder commits an offense if the license holder intentionally,
knowingly, or recklessly carries a handgun under the authority
of Subchapter H. Chapter 411, Government Code, regardless of
whether the handgun is concealed, on or about the license holder's
person:
.
.
.
(6) on the premises of a church, synagogue, or other established
place of religious worship.

If you stop reading there you did not get the complete answer. Further down it says:

(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor
was not given effective notice under Section 30.06.
2nd Amendment. America's Original Homeland Security.

All guns have at least two safeties. One's digital, one's cognitive. In other words - keep the digit off the trigger until ready to fire, and THINK. Some guns also have mechanical safeties on top of those. But if the first two don't work, the mechanical ones aren't guaranteed. - me

Yes, you can carry in church. It's yet another place where the
state of Texas allows us to protect ourselves and others.

Carry at church and perfect your "shielding the gun" behavior
during any hugging that goes on!

No one knows I carry at church. No one will ever know unless
my weapon needs to be drawn for its intended defensive purpose.
N. Texas LTC's hold 3 breakfasts each month. All are 800 AM. OC is fine.
2nd Saturdays: Rudy's BBQ, N. Dallas Pkwy, N.bound, N. of Main St., Frisco.
3rd Saturdays: Golden Corral, 465 E. I-20, Collins St exit, Arlington.
4th Saturdays: Sunny St. Cafe, off I-20, Exit 415, Mikus Rd, Willow Park.

That's what I was hoping, too, considering that I am on stage at church in full view of thousands of people every week including two gigantic video screens etc., so I'm quite high-profile.

But my wife has "bragged" occasionally that I am carrying. So the word is out however much I tried to keep a lid on it.

Wife never starts the subject but when someone says anything about carry or "needing to get on of those pistol permits" she always just says, You need to go talk to the preacher. As she speaks, she hugs her Sig 232 a little tighter. :thumbs2:

Oh it is not like my wife just out of the blue says, "hey Mildred, did you know my husband is packing?"

But if the topic of "hey what happens if some wacko comes in here and starts shooting" comes up, she will more than likely say something like "I figure my husband will shoot back." and they say "does he have a gun on him?!?!?!", she says "yes, of course. he is always carrying", and then they say, "you mean right NOW?!!?!?"...

anyway, this isn't the only scenario, but suffice to say she seems to be pleased that I am carrying and doesn't mind sharing, no matter how often I ask her not to tell someone else. can't get toothpaste back in the tube you know.

I'm in kind of the same boat. The end result is that I now have church friends coming up to me (it happened just last night) to tell me that they are working on getting their CHL. I've had 4 of my church friends take the class this month. The guy last night was the drummer I was playing with, and he said he's going to apply in August as soon as he turns 21. The bass guitarist I played with last night has previously told me that he is applying in July. I believe that our worship pastor took the class this month, but I'm not certain about that. There seems to be a sense of urgency among many in our congregation that NOW is the time to git 'er done. Naturally, whenever the subject comes up, I encourage it.

My worship pastor, who also leads the main worship band, has told me before that he finds comfort in knowing that I am armed and behind him on stage. In any case, I can see a day in the near future when there will be at least 2 or 3 of us armed on stage at any given time.
