I will bet they would be allowed to by law. The only reasonable suspicion they would need is to see you open carrying. Could be a real loophole for a DA that is anti-open carry to have officers checking everyone they see. It would fall under officer discretion, I'm sure. And yes, some officers and/or departments would abuse it, just like some abuse the ability to disarm CHL'ers for the safety of the officer/CHL'er/public.
