Man Charged With Assault After Pulling Gun At Child's Game

A Lubbock man faces felony charges, after authorities say he pulled a gun during a children's soccer game. Police arrested 25-year-old Tye Burke on Saturday afternoon. He's now charged with aggravated assault with a deadly weapon.
Authorities tell NewsChannel 11 that Burke was watching his child play at the Berl Huffman Complex when he apparently got mad at the coach and started yelling at her. They say the coach's husband tried to settle him down, and then those two got into a fight in the stands, and that's when Burke pulled a gun.
"It's unfortunate; it creates a bad situation for everyone. We certainly hate to see that in our community as well as any other community," Lubbock Police Captain Greg Stevens said. Police say an off duty prison guard tackled Burke when he saw Burke pull the gun and point it at the victim's head. Authorities say Burke eventually put down the gun, and they took him to jail.
Investigators tell us that Burke has a license to carry a concealed weapon, but that doesn't give him the right to threaten people. "The fact that the individual had a permit simply compounded the situation and brought into play a few other ramifications that will come into play down the road," Stevens said.
Lubbock police say they will turn Burke's permit over to the state, who will determine what other action to take. Again, Burke is now charged with aggravated assault with a deadly weapon. He's since bonded out of the Lubbock County Jail.
Soccer Dad has his CHL. This is shaping up to be one of those STUPID IDIOT deals.

Exspecially this close to a legislative session. I'll keep my fingers crossed that either this guy didnt have a CHL or maybe he can justify the use (maybe the husband was a black belt) -- Yes I know, I am just hoping!!

This is one reason that I gave up coaching youth sports. The parents took all of the pleasure out of it.

Without more details, it's hard to tell whether he was right or not. Doubtful, though.
If he truly feared for his life, e.g. this guy was kicking the snot out of him or else this guy was 10x the size of him, then perhaps what he did was justified, but I kind of doubt that was the case.. ??

What a mess. I'm sure the anti's will be lining up to take a "shot" at us over it. It sure does not look like he tried to defuse the situation...sigh...

If accurate, it is a sad commentary...and begs the question: If this man can not control his emotions concerning a soccer game, then how can he be expected to act appropriately when deciding to use (or not use) deadly force.
Time for him to "grow up".
If it turns out he was in the wrong, then other CHL holders should roundly condemn his actions. We must police our own, there is no room in the CHL community for "Hot Heads" .

If he goes to trial, the jury shall be of his peers, right? So we should ensure fellow CHL holders are on that jury, therefore assuring the public that we can agree he was in the wrong, and not all CHL members would do the same should they be in his shoes.

Isn't this construed as a "sporting event" in which he couldn't legally carry anyway?

You can carry at sporting events if they are not school or professional events. If it was just an area soccer league, similar to a little league baseball game, you can legally carry at the event.

I always took the "sporting" clause to mean "gun sporting event" but I just re-read it and indeed it just says sporting event.
Also, if this was a SCHOOL related event, well, that's an even bigger UH-OH for this guy....

I agree with Keith B. Sounds like this guy started it and then escalated it. Seems to me his blood was rushing and got irritated and did not think. This is not what the CHL is about. It does not give you the right to point your gun at anyone for anything. That was irresponsible and stupid. All it takes is one bad seed to make us all look bad. We need to work even harder now to portray the right image for us.

You are right! They see this ONE incident involving a CHL holder and are completely oblivious to the other stories where CHL's and gun owners end up saving lives.tbranch wrote:What a mess.
