Man killed kicking in door of wrong house

A "highly intoxicated" Texas City man who kicked in the door of a home he apparently thought was his own was fatally shot Friday night by the man who lived there, police said.

David Wayne Stewart, 26, who officials said was drunk when he left a fast food restaurant Friday night, walked in the direction of his home and stopped at a different house, in the 900 block of 26th Street, where a 55-year-old woman and 74-year-old man lived.

Stewart knocked and banged on the door around 11:30 p.m., and when the resident refused to let him in, Stewart kicked in the door. The resident shot him once in the head, police said.

Stewart was dead when police arrived. The case has been referred to the Galveston County District Attorney's Office without charges.

It’s a good thing they had a gun. Someone that drunk might have killed the residence thinking they were robbing his house. Sorry that someone had to die but it’s better its the one who swap his intellect for liquor than the law abiding residents.

The term Stupid Drunk definitely applies here. I don't drink so I just can't relate to why somebody would get so drunk they don't know their own house.

Kinda scary. I've had that happened to me at 3AM before. Luckily he just banged on the door for a good 15 minutes and didn't bust it down. :shock:

A fireman told me one time he went into a home and had to wake a family up. He said he was in full gear and it startled the home owner. Fortuanately the man was not awake enough to engage his gun or the fireman would have been dead. That has always scared me from the time he told me the story.

If the BG was dead I am curious how they know what he was thinking. Maybe he was thinking home invasion?
