I really don't know which way to go on this. He did do what the scene commander was hesitant to do and that was just get in there and do something. OTOH, he also had a daughter and wife in there that he went to first to get to safety when other parents were being prevented from going in when other officers were not. This was a mess all the way around. At least this guy was there whatever his motivations were.

I think that if the police were trying to keep me from going in after my loved ones, while they did nothing, they would have a pretty serious situation on their hands.

I sympathize with his motives and I would probably have done the same thing as far as the famiiy is concerned. How much did it delay him we will never know. He did what no one else was doing. THANK him.

I would not be surprised if after the dust settles we see potential criminal charges filed against the IC and/or those “controlling” the scene. Sure seems to me like all four elements are met.
Duty of care - that should be clear as LE profession has this inherent duty.
Breach of duty - this might be muddy but I believe the standard (by which the IC et al will be scrutinized under) is that in the case of active shooter you go in, there’s no waiting around.
Causation - could be muddy, but again, given the profession expectation from the 1st element this could very well apply.
Damages - this one is clear to me.
Of course, IANAL but it sure doesn’t look good.

Browsing through some replies here and others on many other social media platforms makes me see some commonality in response to this mass murder. There are a lot of questionable things about this but it would be helpful if people would leave out the ad hominem attacks and stick to facts. I see the right complain about the stereotypes and then turn around and use the same reasoning on others.

This incident has further divided our country and is causing many more attacks on our 2A rights. Things like this are having a cumulative affect over time and will eventually drive us to a civil war if we choose to let those in charge manipulate us. I miss the days when I could have different political and religious views and each side not hate one another or want to kill the other side for believing different. I've seen more of the division and hate being stirred up with this mass murder and the facts be ignored by both sides.

Don't let yourself be the stereotype the left makes us out to be and don't let our misguided, narcissistic and selfish leadership drive us further apart when it is not necessary. Christ is the only answer and hope for our country and I pray that God will not let us go the way of many other great nations.

Speaking ONLY to that highlighted line, I must be misunderstanding this one. I was under the impression that the SCOTUS has ruled, multiple times, that police have ZERO responsibility to protect anyone. So how does that duty of care thing work, then? In some generic sense? I've never been a police officer, I'm an aircraft mechanic and electronics technician, and my knowledge regarding the subject is extremely limited.

I would agree that it seems that LE should do all that, but as we know for ourselves, we cannot be prosecuted for not acting to stop a crime unless that has changed. LE agencies may put that on their vehicles and take an oath and everything, but as K/Mooneyham has reminded us, the SCOTUS ruled a while back that LE also cannot be held responsible for not acting. At least legally.

I do have a suspicion that the good people of Uvalde might be rethinking their city councilman choice and will either seek a recall or ask the newly elected councilman to voluntarily step down.
