I agree with your assessment of the options available to the solo officer. I also agree that the statement released by Plano PD and excuses made by the Plano PD chief are troubling at best. I am hoping that city council raises these issues at a meeting in the near future. They were legally prohibited from doing so on monday as they are required by law to have the agenda posted for 72 hours prior to being discussed in council. This went viral on Saturday, so the 72 hour mark didn't end until Tuesday. In talking with one of the council members, this should be brought up at the next meeting and he has some questions for the chief regarding the statement released, as well as some of his public answers regarding the incident.

The statement by the Plano PD said that it is not illegal to draw and point a Taser at someone who is in a heated argument with a 3rd party, while you and the 3rd party are in the act of committing a crime.

So if me and my friend box someone's vehicle in on the roadway and refuse to let them leave, short of abandoning their car, and I then pull out a Taser and point it at our victim when they start to yell at us, I will have committed no crime whatsoever? I really wonder if the police chief would have this same legal determination if it was his wife or his kid who was the victim here instead of some random guy that he does not know.

Had this discussion last night with a council member. It would not end well for you or I to point a "electronic control device" at a police officer. Like I said, the statement is troubling at best.

I grew up with my dad's police buddies drinking coffee at our kitchen table, I have gone hunting with those men when I was a little boy, when I started out as a volunteer firefighter I worked with and around those guys when I went paid at a neighboring city I worked with and around those guy, went to SWAT school to become the Medic for the Swat team, I know that you point anything that vaguely resembles a gun at a Police Officer there is a REALLY GOOD CHANCE YOU WILL GET SHOT!

He has confirmed to me that yes, indeed, these human scum are training at Elm Fork (and wearing antifahahaha shirts/clothing)...they apparently are well within their rights to be there, as the management has apparently kicked them out before...and I guess they maybe have done some legal wranging? But either way, they are there, they are *very* closely watched by the RSOs...he relayed this encounter with one of the slime: "So, are you guys afraid of us?" So by that standard, the only person who was charged (for slapping away the woman's phone) would have been justified to shoot the guy with a Taser pointed at him.

Sounds like the Plano police chief is just full of it.

If Elm Fork is not publicly owned then how the heck can they be restricted from kicking out anyone they want? Political beliefs are not a protected class as far as I know.

That is a bit of good news. Demonstrate and protest if you have something to say, just do it legally and don’t infringe on other rights. And, don’t destroy things or assault people.
