Short answer: "We don't have a definition. But we'll know one when we see one. We'll tell you when we do. Until then, good luck figuring out if the one you already own is going to put you in violation of NFA regulations.""Accordingly, ATF must evaluate whether a particular firearm configured with a stabilizing brace bears the objective features of a firearm designed and intended to be fired from the shoulder, and thus subject to the NFA, on a case-by-case basis."
...
"No single factor or combination of factors is necessarily dispositive, and FATD examines each weapon holistically on a case-by-case basis."

Their proposed definition looks extremely vague.

I’m waiting for the next shoe to fall...redefining what an AR pistol can and can’t be...or better put, redefining an AR pistol as an NFA item...
Over/under of that happening under a Biden Admiistration - 85%

The rules would make all pistols with a brace NFA items, All pistols with brace can accept attachments, rails, and large capacity magazines.
BTW, is a person using brace-pistol not allowed to use a rest to shoot from the bench?!

Re: ATF to Institute Rulemaking Regarding Stabilizing Braces and Require Registration of Currently Owned Braces
IANAL, but that's not how I read it. The proposed rule doesn't say anything about what "could possibly" be added to a firearm that includes a stabilizing brace. Rather, U think the determination needs to be made based on what is actually on such a firearm. So a Red-dot or iron sights would count towards a pistol (as would anything with unlimited eye relief). I didn't see anything about magazine capacity, and I personally own a pistol that has a 100 round magazine (though 50 round mags are also available for that pistol).
I think this rule is saying that everyone needs to compare their firearms with a brace to the factors listed and we then need to make our best judgement as to whether, on the whole, it has more factors of a pistol or a rifle. If the ATF or any other LE agency happens to see our firearms and they disagree with our determination, then a jury can ultimately decide the issue. And if we are wrong, then we should be able to register these as NFA items without paying a $200 tax. Am I reading this completely wrong?

I know we have all heard the Franklin quote but it is more important today...
We must all hang together, or assuredly we shall all hang separately.
Benjamin Franklin
First it was bump stocks
Now its pistol braces
Next it will be all AR "Death Machines"
Then it will be semi automatic shotguns
Then pump shotguns
They will not stop. We must fight together!

There's a lot I'd like to say, but I'm not putting it on an open forum with anti-2A people monitoring it daily.

Maybe Regina Lombardo (acting director of the ATF) is worried Beto will get her job next month so she is showing
Biden that she is "getting tough on those gun folks."
Just a thought. Otherwise, come on, what is the need for any of this?

Please know and follow the rules of firearms safety.
Re: ATF to Institute Rulemaking Regarding Stabilizing Braces and Require Registration of Currently Owned Braces
Just going to say this is the result of everyone rolling over on bump stocks including the NRA to a degree. This is the next step regardless of how you feel about braces either way. Encouraging or looking the other way on this will lead to yet more non-legislative actions to curtail 2A rights. Our paths to stop these types of actions are limited to the courts unfortunately given the incoming administration. Boiling the frog is the right example here as we have made ourselves too comfortable and the populace has never had to live through any real strife in my lifetime so they aren't willing to fight to get out of that pot.
