Being that the entire mall is managed by the same entity that posted the signs, I'd stay away. I'm not aware of any case law or clarifying statute on this yet. If it exists, I'm sure someone here knows about it. The communal environment of a mall makes the situation a bit more hazy.Rex B wrote:What if you are just going to that dept store? My experience with mall workers suggest that they are not gun-friendly, and if you were somehow found out, there is the possibility of at least taking a ride. In that situation, you may quite possibly be charged with trespass once mall management finds out about it, and then you're going to need a lawyer. I recently went in to get fitted for a suit at Men's Warehouse (in a non-posted mall) and advised the lady working with me that I had a CHL and was carrying and wanted to be fitted with considerations for my carry gun. She hemmed and hawed (no pun intended ) about it and went into the back for several minutes and returned. I then noticed the mall security folks camped outside the store in their SUV (there was an outside entrance) for the remainder of my time there. She wouldn't fit me for the gun, and I had to get measurements taken, then return to the changing room each time to test for fit. I ended up unable to use my normal carry gun with the suit, as there was too much printing for my comfort and have to resort to my BUG when I wear it.
If it were a strip mall, I'd say it would be a different story because there is no free access between the stores, although a manager could arguably post for the entire strip mall. Posting seems to be usually done by individual stores in those instances, though a parking lot could have signs, effectively making the entire place off limits.
