A loophole is a legal way to avoid a law.
If a firearm is sold to a prohibited person through a private sale in Texas, both the buyer and the seller have broken the law.
I believe Abbott made an incorrect statement concerning this too.

That "kid" was 20 years old and did not purchase any firearms. He took his mom's, killed her with one, then went to an elementary school to kill more before killing himself.

The only way that mandatory background checks could even come close to working, is to have defacto registration of all firearms, as well as an England type of unannounced mandatory checks of your "now registered" firearms by Law Enforcement. Yep, that's right a good old police state, a Democrat's dream and a true Republican's nightmare. Next, with those glorious Red Flag Laws, the removal of all firearms from those one dislikes, even maybe get some icing on that cake, get 'em killed as well. Out of almost 175 million gun owners in the U.S. how many will go for it? Unfortunately most will, shoot we can't even vote as a block, in order for one to vote, one has to be over 18, and to be a gun owner one has to be over 18 as well. So, all of those 150-175 million gun owners are at the very least old enough to be voters. There aint but 320 million total folks in the U.S, that includes people under 18, Felons, current prisoners and etc. This tells me that the majority of voters in the U.S. are gun owners and here we are going down this rabbit hole of blaming our tools for other folk's problems as well as many not having a problem with giving up their freedoms for media talking points. What's that term everyone uses nowadays? I have always been a strong supporter of private gun sales. I will continue to be a strong supporter of private gun sales, ownership of AR-15's, suppressors, armor piercing ammo, short barreled rifles & shotguns, and even machineguns by law abiding citizens. Private ownership of military arms, without ownership lists (only useful for confiscation) was how our freedom was won and how it is maintained. That is what authoritarians fear more than they can ever admit.
I would dare to say authoritarians everywhere are completely terrorized by the thought of law abiding citizens who own these arms and ammunition and know how to use them to a high degree of proficiency.

Politicians all live in a bubble. They are going on information they receive from their staffers and other insiders. They all want to retain office. With all the bull crap saying Americans want stronger gun control they start thinking it is how to keep in office. Many Americans are easily programmed. It is not very hard to scare the crap out of them and convince them that giving up their freedoms will make them "safe". I have said it in here before but all one has to do is go back to the world trade center attacks to see how easy it was to convince Americans that giving up their privacy rights was worth being "safe". The government and politicians know this and will use it to increase their own authority and power over the people.

Two people who are residents of the same state are allowed, legally, to buy and sell firearms to each other, without a background check, so long as the seller does not know that the buyer is a prohibited person (and is not required to ask).
