Some advice please

Most CHL/LEO contacts are positive, how about yours? Bloopers are fun, but no names please, if it will cause a LEO problems!

Then you agree that he should be reported to DPS so internal affairs can investigate and determine whether he actually did something wrong.

If the public servant did nothing wrong, then he has nothing to worry about. Right? Isn't that what the police said when asked if they have a warrant? Shouldn't the same standards be applied to the cops?

If he is guilty of abusing his power, then he should absolutely lose his job. This isn't the Dukes of Hazzard. The DPS is a professional organization that has earned the public's trust and admiration. I doubt they would take kindly to a bad apple tarnishing their reputation.

How many DL offices have a captain working there?

This is insane! Im so glad he will be out of your life, but its so sad that basically... nothing was done.

Sure he's moving to El Paso, coincidentally, but he will just continue with his power trip over there :(

It must be the place for their 'problem children'. We had an issue a couple of years ago at the DL office.

We were training a service dog for use by the handicapped. The dog went EVERYWHERE with my wife. She was at the license office for about an hour waiting in line. The dog was laying beside her the whole time, not making a sound. The local DPS Sergeant came back from lunch and spotted the dog. She had the DPS trooper assigned there come out and tell her she had to leave. My wife tried to explain that the dog was a service dog in training, and state law says they are allowed anywhere. The trooper told her his supervisor (the Sergeant) said if she didn't leave he would have to give her a ticket.

My wife said she would step outside with the dog, but wanted to talk to the supervisor. The supervisor came out, and from a distance, told her she could leave the dog in the car (no way as it was 95 degrees outside and the rules are the dog stays with you.) She tried to explain, but the Sergeant just said no and walked back inside. We really think the Sergeant was afraid of dogs.

My wife called me while taking the dog home and I immediately called Austin. They put me through to the Captain over the DL Division. When I told the Captain what had happened, she said 'Oh no" and apologized. I advised her that refusing to allow a service dog access to a building was a Class C misdemeanor. She told me I would get a call in just a few minutes.

About 5 minutes later, the Lieutenant over this office called. I advised of the situation. He apologized and said it would be straightened out. I asked the Lieutenant to have the Sergeant call me so I could see what her reasoning was for ousting the dog, and get an apology from her. He said he would do that and again apologized. By this time my wife had taken the dog home (about 5 miles) and gone back. Luckily they allowed her to go to the front of the line.

I didn't receive a call the next day, so I called the DL office. I got in touch with the Sergeant and she told me a lawyer friend told her only seeing eye dogs can be in buildings. I told her she was wrong and to check the state statutes. She said she had been advised of this now and why did I call the Captain? I told her ignorance was no excuse for the law and she said, 'Well, people make mistakes." I said "In uniform, you are to enforce the laws as written and if you don't know the law, you should not make up your own interpretation." She stated she didn't need ANOTHER black mark on her record (hence the DL position maybe??) I told her next time to make sure she understands the law. She hung up and never did say she was sorry, so the Lieutenant got a call back. He said he would write up a formal complaint for me.

Long story longer  in the bureaucracy of the government system, it seems like there are places they put the bad eggs so they will ride out their time and not stink things up too badly.

I've been watching this thread unfold and I believe that you should be congratulated on your actions and self restraint. You acted responsibly by getting it checked out, and self control and respect by not going for blood. (ie. Suing the guy.)

I'm amazed that a guy with his attitude got through 26 years with DPS without blowing a gasket and crossing the "brutality line".

I suspect that this isn't the first such incident this guy has been involved in. I base that on DPS's response to you and the fact that they are shipping him out as far away from Houston as they can. It looks like if Texas extended all the way to the North Pole, they would have had this guy patroling in a kayak.

I understand that he was an award winning officer until he married for the first time in his life 7 years ago to someone almost 30 years his junior. The way i figure something in the last 7 yrs has turned him into this very unhappy person who hated me on site. I kinda feel sorry for his realitive in HPD who will probaly get a write up if not something worse as two of the cars in my warehouse belong to police officers in my car club but i was unable to say that before cause they along with my lawyer made the problenm known to DPS. My family and I are very proud that I was able to straighten my life out and get married and have a family given the path i was on over 18 years ago,as Longtooth told me god had a different plan for me.

I've been following your story. I'm glad to hear he's out of your life now, but am sorry to hear that he will still be an LEO somewhere. Cops like this are the reason that I'm not comfortable being disarmed for a traffic stop.

:iagree: It sounds like DPS has handled the problem, and I'm sure HPD will take care of any business they need to as well. I'm glad that the situation looks like it's being resolved, which I know will give you some peace of mind.

Maybe the DPS should ask the catholic church how shifting around bad apples has worked out for them! Or worse, this guys next victim. I'm probably more disappointed in the DPS for letting this continue.

Bevans,

You really handled yourself very well in this ordeal. You dealt patiently and yet effectively with this guy and prevailed. If you had troubles earlier in life, God certainly has turned you 180 degrees around. Again, way to handle the situation.

I'm locking this thread. I posted a notice that we were replacing the "10 Year Old Daughter Rule" with specific forum rules. My post also included an explanation for the change, as well as the new rules.

As noted in Rule 11, we are lenient on off-topic posts, but LEO Contacts & Bloopers has been a problem area and we are going to take a much narrower view of posts in this section.

Unfortunately, only 101 people out of 2100 members have viewed my post, so I suspect many people are not aware of the change. Here is the new rule on LEO posts:
Forum Rule 11: wrote:11. Off-topic posts/threads: We do not have an off-topic forum because they tend to cause the most problems for any board. We have gotten rather lenient in allowing off-topic posts, but this has become a problem in recent months. At this point, we are not going to prohibit off-topic posts, but please observe these guidelines. Off-topic posts must be at least remotely related to one of the topics listed in the titles of the sub-forums or their descriptions. This does not apply to prayer requests or LEO Bloopers, but it does apply to LEO Encounters. If a LEO encounter didn't involve a CHL matter, then don't post it. (This has been one of our more troublesome subjects in recent months.) We will continue to evaluate the off-topic post issue in the coming months.
Here is a link to the new Forum Rules
