IDK, this might be a case of 1911 junk.
What if he really did sit on it and happened to disengage the safety and somehow activate/release the hammer? Possible? Of course, who sits ON any gun, let alone while driving.
I bet all you appendix carry folks saw the thread title and were a little cautious about opening and reading this thread's link.
Regarding the possible charges ... I think if I were the DA I might be tempted to just leave things be. No need to add insult to injury.

I've actually seen that several times when I worked in the ER. It seems that SoCal gangbangers are unable to resist the charms of stuffing a .22 or .25 down the front of their pants, sans holster..........although one enterprising young man, with a vision and the ambition to carry it out, chose a .32 instead.......
