UPDAT-Wife is here on work visa and wants to get a gift for me =) so we need help!! =/
UPDATE--Hi, my wife is not a U.S citizen and is only here with a work visa, I am a U.S citizen and do have my CHL she is trying to get me my dream gun (Glock 27 Gen 4) as an early Christmas present. I do know that her not being a permanent resident or U.S citizen (even though she resides with me in BIG o'l TEXAS) she cannot apply to own a gun if I ain't mistaken, so what we want to know...is if we BOTH go to the gun shop or academy per say...and pick my gun out and do the paper work making everything under my name since it will be mine, can we use her credit card to purchase the Glock?
I have been searching for answers but some say you can and some say you cant. also just to add she is a legal immigrant and does have her visa, TEXAS drivers license and REAL SSN before anyone starts nagging and not helping....thanks.
Good day to all~, I just wanted to give an update on my situation that I had a couple of days ago. it is easier if you just get a gift card or certificate to purchase a gun even though I don't see the big deal on your spouse just handing her card or money to the clerk if you are the one who's info is on the paper and is there writing it. but anywhoo just wanted to throw that out there. also my wife or anyone that has a SSN for the US can purchase a firearm as long as you have proof of residence and proper documentation to be here, you can even get a CHL. so thank you all for your responses.

I don't know much on the subject, but I do remember an interesting read from some time ago.
This will likely not answer your question fully, but may point you in the right direction:

You should have no issues purchasing the gun if you do the paperwork. The gun is for you and you will be filling out the paperwork. Who supplies the money does not matter if the gun is truly for you. I used to sell guns for Academy and this scenario was quite common.

holy,... to you man... that article actually helped...now I am considering on checking on the process for her to obtain a CHL for what I read. that's if the law hasn't changed. so far, what I read she can actually apply since she has no felonies and does have her Texas license and documents. thanks a bunch..I will leave the article open just in case someone has the same issue. thanks once again.Vol Texan wrote:I don't know much on the subject, but I do remember an interesting read from some time ago.

She can if she is Canadian and has a hunting license, but it's probably much easier for her to give you a gift card

roger, we will try it that way, before she fills anything out. although I was directed to a link and learned that she might even be able to obtain a CHL of her own. anyways hopefully this purchase goes well, cuz I been wanting that Glock ever since it came out.

Here's a crazy question. Is the credit card just hers or is it to the same account as yours, but just has her name on it? That's how my wife's and mine are and we've had no trouble with her throwing down the CC and me doing all the paperwork in my name since the two guns she has bought as gifts were both for me.

Oh well, I hope you're able to get this done without any trouble. For some folks it will be plainly obvious if you both go in together who the gun is for and as long as you're the one filling out the paperwork won't be a problem. However, there may be others that have seen one or two cases in the news the last couple of years about straw purchases and a couple folks got into a pretty good amount of trouble over it all.Octive09 wrote:no, its only on her name. but that is not a bad idea. thanks for the advice.C-dub wrote:Here's a crazy question. Most shops sell gift cards. Have her purchase a gift card for the amount, plus tax. Then go in and purchase it with the gift card.

Stop by the bank and get cash. Go to the gun shop together and purchase the gun in your name since it's going to be your gun regardless of whether she can or can't buy it herself. Going together will make it even more special. And heaven forbid you should ever break up but if you do there will be no doubt as to who owns the gun.

It does seem like cash , gift card or simply transfer the price to your account/card would be fail safe to avoid problems .
