The Fourth Circuit rules AR15 rifles are not protected by the Second Amendment.

Hope Gorsuch gets on the bench and helps to change this result when it gets to the SCOTUS.
The good news is this ruling should have no effect on Texas law.

This flies directly in the face of the Miller decision, which said that since short barreled shotguns, had no use as a Military weapon they were not protected. If they have decided that the AR 15, is a military weapon, how can they claim it is not protected?
I have completely given up on circuit court decisions. They will never meet scrutiny under SCOTUS.
I don't worry about Texas, the Governor has already issued his edict, to " Come and Take It"

Judicial tyranny is what it all boils down to.
What? There where no AR-15's in 1787? It's clearly unconstitutional!!!!
Now these geniuses are deliberating on whether our Constitution applies to foreigners. Geez. Throw them out on their over privileged leftist bums already.

Intermediate scrutiny on a fundamental right. Bad form.

What's next? "Merry Christmas" isn't protected by the First Amendment.

That does kinda make you wonder if any of those judges/idiots have stock in any firearms manufactures of AR's.

It will be interesting to see if anyone is dumb enough to try and confiscate AR15s owned by Virginians, West Virginians, and by North and South Carolinians. I don't think it will fly.

They won't confiscate. They will ticket/arraign anyone caught out in the open with a prohibited firearm, so that people never take them out of their closet again. That is for any state with similar laws.
If they just started confiscating, gun owners would actually do something. But you know what they say about frogs and boiling water.

I don't know...... Maryland can get away with this .......in Maryland. But gun owners from those other 4 states are made of sterner stuff, and I think a whole lot crankier about gun-grabbers.
Wasn't it in one of those states where the AG tried to ban certain weapons, or cancel reciprocity or something like that, and the legislature threatened to defund the AG's personal protection detail, so the AG changed his/her mind?

I think it would have to be the feds or a big city police force to even think about confiscation or a citation in those states. Even a citation might be dicey.

Wait, who said it was protected? It's actually prohibited by the subjugation of Church by the State clause in the first amendment. Don't believe me? It's in there and the courts will back me up on it....
Ok, my Sarcasm has run completely dry.

Reading all 100+ pages of this made my head hurt with their convoluted logic. Hopefully Gousuch will be confirmed and then the SCUSA will slam these folks.
