This is a limited test case since it deals with the designation of court locations where there is some flexibility in the law. Although this may well call out the need for some changes in the law (limitations on locations that can be designated, etc).RossA wrote:Well, it appears that the AG did what he was supposed, the city pushed back, and now we get to see whether the AG takes action or rolls over. This could be the test case we are looking for.
Well, that case would be perfect for a temporary sign.JP171 wrote:I think the city is way over stepping, most small cities including the villages have a judge comes in one day a month and use the common room same as city council uses. the place you usually go to pay your ticket in normally in the pd. so yea umm.....can we say doing it cause we don't like guz, gunz are bad mmmkay...and we figured out a way to get around that pesky law we don't like
The current law allowed judges discretion in designating areas. Implicit in this is the assumption that the judges would be mature enough to be entrusted with this responsibility. Some have shown that they are not. So just like the 6th grade class where one kid abuses a privilege, it may now be time to take that privilege away from all judges and get proscriptive as to what areas can be so designated.JP171 wrote:I think the city is way over stepping, most small cities including the villages have a judge comes in one day a month and use the common room same as city council uses. the place you usually go to pay your ticket in normally in the pd. so yea umm.....can we say doing it cause we don't like guz, gunz are bad mmmkay...and we figured out a way to get around that pesky law we don't like
