The Bill of Rights is IMHO NOT a bill from the government to the people, which implies that they are rights given by the government to the people. I contend that, for example, the 2nd Amendment does NOT gives us the RKBA. The RKBA is an inalienable right endowed to us by our creator. The second Amendment, as well as the rest of the Bill of Rights, is a restriction on the government on infringement on those rights. We should stop saying the the 2nd gives us a right, but we should be saying that the 2nd prevents the government from infringing of that right.I believe that the Bill of Rights were that, a bill from the government to the people of certain rights, not privileges, not exceptions, not waivers, hard and fast rights, inalienable to us all on birth in the United States of America.
My son (bar mitzvah'd almost a year ago) and I were having this discussion the other day. He understands (amazingly enough for his age) and agrees.
